Sub: illegal vs legal

Collection of an unpaid debt is illegal when the collector/employee uses harassment and intimidation to collect a debt. If you are contacted, do not make any payment arrangements over the phone! Do not give out any information such as address, social security number, etc. Always resond to them via 'registed receipt requested', first class, U.S. mail. Remember they must prove you are the owner of the debt, you do not have to prove anything if they cannot come forward with true, unadultered, original copies. Instead, get their address and send them a "Request for validation, made pursuant to the Fair Debt Collection Practices Act asking for these copies. Please note that you are requesting "validation"; that is competent evidence bearing something with your signature, showing that you have some contractual obligation to pay them. Most likely your contracts will be with the original debt holder and they will not have these if they are junk debt buyers. Also note in the letter that it is not a refusal to pay, but a notice that your claim is disputed. Good Luck and God Speed.

what exactly is the conference call about? Is it a way to have our grievances heard, or are you just recommending people call to cause havoc?

Likely an annual report. That actually might be good one to listen in on.

what sorts of things do they talk about? Just the general financial health of the company? Or more in depth than that?

I think that if it's a call where their management is present, and willing and able to listen to grievances, it might be a really good thing to have a captive audience!

It would seem that I am not along in my battle to take down "Palisades Collection". We to have had problems with tracking down this agency to find out that they have sold the collection yet they keep reporting the debt.

by deal do you mean settlement? because if so then its tough beans unfortunately. they are not required at any point to offer a settlement. though the best time to negotiate is usually the end of the month when they are trying to hit their goals. but be prepared to explore other options - like a montly arrangement.

I have disputed Pallisades which is still on my credit report. They attempted to sue me, and after weeks of hassling with them, they dropped the suit "with prejudice" meaning they can never come after me again. I have disputed it, I have demanded verification of the debt, all in writing, all by certified mail. They still refuse to remove it from my credit report, or even post on there that it is a disputed debt. When I attempted to dispute it through Experian etc. they said they found the debt to be valid. How is it valid if I never had a debt with the company they claim to have bought my debt from? Now what do I do? I can't afford an attorney to sue, and my credit is ruined.
