Community discussion - Palisades Collection is not cooperating!

Kermit says...
The thing is, this collection also is beyond the SOL in MN, which is 6 years. It drops off my wifes CR in June 07, but we are getting a house before that. This is our delima, I'm afraid if I DO contact Palisades, they will try to collect again, or "Re-age" the account. That's why I am debating on whether to contact them or not, I don't even know if they will believe her about eh ID Theft and just bully her around.

I DON'T was to start anything up with the CA in risk of them messing up her CR more. Especially since it's so close to being dropped off, and it's beyond the SOL.

Any advice???????

I have no old debt at all and I just recently have been getting calls from Palisades and True Logic. They are fraudulant. I am sending them a validation letter to force them to send me any info on what they alledge I owe them. From what I read on Link deleted as per forum rules - Mike
, a validation letter will not extend the SOL. I would go that route & take the fight to them instead of hoping they go away. Having read up on Palisades, I don't think there was any ID theft, I think they are just inventing a fraudulant claim against you in the hopes you will agree to settle over the phone. Good Luck

On a side note: I have not even spoken to Palisades on the phone. Your best bet is to only deal with them through Certified Mail w/ return receipt. They will be much more hesitant to try their scams via the mail as opposed to the phone.

We should file a petition to all credit agencies to have these claims removed from our files. I just got off the phone with one of the Credit Agencies and they are trying to help but the people at Palisades are a problem. It seems that they bought all of ATT pending bills files for pennies on the dollar and wihtout consulting with ATT collections they have initiated the process of trying to enrich themselves by harrasing individuals and reporting them to the credit agencies. The catch is that most of us would rather pay a couple of hundred dollars in order to be left alone and in some cases this has a very serious and adverse effect on personal finances as transactions such as mortgages, and other important transactions are denied due to a mere claim from this organization.
We should launch a class act and close this fools down once and for all. My claim was for less than 500 dollars and it is been outstanding since 2003 without any resolution. More over ATT is no longer so who knows what is going to happen to these claims.
My advice is that we should all write multiple e-mails to the credit agencies and hihglight PALISADES WRONG DOINGS with a copy to BBB.

good luck

We cancled our att account and they kept billing for several months. Now we are being sued by Palisades. They never contacted us and we found out about this through the court. Do I have any way to settle with them without hiring an attorney or what would be my best bet on this ?

I received a letter by a person that came to my house. The letter has a delivered stamped but has no delivery date. It has a came to date of 11-02/06 but I received it on 11/10/06 but that is not on the letter. Houw do I know this is legit. It has a judges signature, a case number and it makes refference to an "Exhibit A" that only shows my information. Should I contact my attorney do deal with this matter. Can they sue me without previous notice?

If this is a kind of a summon, the local county should have the complete records. Some companies try to misinterpret by giving the summons a legal shape. Maybe, Palisades is doing something like that so that you send them money out of fear. Check with the court and if you haven't got the debt validated, draft one letter to their address. You need to build proof in front of the judge that you are taking care of the matter.

I also received a collection notice out of the blue from allied interstate who was representing Pallisades. I immediately requested documentation to substantiate the validity of the claim and was told my request was forwarded to Pallisades. Thanks for the number so I can follow up on my request and try to get to the bottom of this.

For the past 4 years, my husband and I have been living in Germany. We have now just moved back to the states in July of 2006. And I am now attempting to keep a good credit for us for future purchases and good standing. I have received mine and my husband's credit report. And I come to find out that there is a dedt with the Palisades Collection LLC with the amount in $962.00.
When we were in Germany I remember receiving a letter from AT&T that came to our mailing address. We attempted to contact the AT&T company and informed them that we are nowhere never the states and couldn't possilby be our account because we weren't living in the states at that time. When asking what was the address was on the account made at the time purchase. I found out that it was my Husband's ex-wife that made the account in his name when she was living in the states at the time we were living in Germany. We obtained a credit report my mail at that time. But found that it was not on it, so we not able to show proof of fraud on her part.
With little research on the internet, I come to find out that Palisades Collection LLC has bought the account of the ex-wife's dedt. Now do we just sent a validation letter to these guys and the Credit Report and telling them that it's his ex-wifes account and not ours?

I have a several collection accounts that I am dealing with. I unfortunately had to address 4 of them to include Palisades and send a partial payment along with an offer of a payment plan. I would have rather not done that and asked for debt validation. But I have a government clearance and those 4 came up in question. The govt. wanted to see progress on my bills i.e. some kind of payment. Otherwise I would lose my clearance and possibly my job. So I plunged in and sent Palisades 10% along wiht a letter explaning my circumstances. This is a text of my letter. Let me know what you think. I guess my question is that there is no going back and trying to get the debt validated, right? Unless they refuse my offer for whatever reason..

RE: Account # 0------0 AT&T Wireless

To Whom It May Concern:
According to my records the balance of this debt is $ 382.38. I am not disputing this debt however; my current financial situation prohibits me from paying the amount you're demanding. I am able to make payments on this account once a month on or around the 15th to your company in the amount of $55.00, which should approximate 6 payments.
As a show of good faith I've enclosed my first payment in the amount of $57.35 (15%). The offer of payment I have made to you is the most fair and sustainable payment I can offer. It is my intention to discharge this debt at the earliest possible opportunity, and therefore, I can assure you of my integrity and commitment in dealing with you and the debt. If my financial situation improves enough for me to increase my payment amount I will contact you immediately.
After the terrorist attacks on September 11th of 2001, I was called to military active duty and served our country for 2 years. Upon my honorable discharge in 2003, I was immediately laid off from my employer. Since my work experience was in a declining industry during the country’s economic downturn, I was unemployed for a year and therefore unable to meet all my financial obligations. I have been gainfully employed, at a considerable reduced wage, for the last 2 years and am slowly paying off creditors and rebuilding my credit standing. Given my circumstances, I am eligible to file for bankruptcy as I have consulted with a law firm that handles bankruptcies. However, I prefer to struggle through this difficult time and pay all my bills in full.
I would appreciate a letter from you confirming your acceptance of my payment terms. However, if I do not hear from you, I will consider your cashing or depositing my check as confirmation that you accept my payment terms. If you do not accept my terms then I expect the enclosed payment to be returned to me immediately in the enclosed self-addressed stamped envelop.
Should you decide to decline my offer and take legal action to enforce this debt, be advised that I welcome the opportunity to show any judge my efforts to resolve this issue. I have kept extremely accurate records of all correspondence and payments concerning this account and have complete confidence that any judge would agree that my efforts have been in good faith.
Sincerely,

This is common practice for collection agencies to create fake bills in relatively small ammounts in hopes that you will just pay them to get your financial freedom back. Really, what is 150$ when you cant get your student, car or mortgage loans on time???
If you wait for these fraudsters to fix their lies, you loose your school placement or house you wanted.
Its simple really - a well calculated extortion ring that has no laws!
If they are questioned they simply lie and say it was a mistake..... Its a brilliant, no fail scam.

Dear Group;

Palisades Collection, LLC, and a number of sibling entities are owned by Asta Funding, Inc., a Delaware Corporation, and a member of NASDAQ, as "ASFI". The principals are: Gary Stern, President and CEO, Mitchell Cohen, Nan Bellinson, and Robert Knight. They principally get their money to operate under a lending agreement with Israel Discount Bank of New York, a "New York Banking Corpation." All of this I pulled up from the various web links between these entities and items found in SEC reports.

In our experience, they gave us two different stories as to who owned our account, which we were already disputing through NASD arbitration and applying California's offset law (CCC 1498). Then they sued and used an agency that didn't bother to serve us. They fouled up by describing my husband on the so-called proof of service. It was laughable. The description and my husband's appearance--which is well described on his driver's license are VERY different. So we ended up with a summary default judgment against us because we had no idea of the suit or what it entailed. Now we're moving to void the judgment and quash the false service.

Does the name "Shylock" mean anything to anyone, here? That's the characer type of entities with whom you are dealing. Let's put it this way, if Al Qaeda were to target the HQ of this company in New Jersey and its lending bank, next time it's crazy enough to go after something in the New York vicinity, few would or should miss them.

It also doesn't say much about who the NASD lets into its exchange or membership, either, but we've all known that both NASD and NYSE are dominated by greedy, amoral, servants of Mammonas since at least early 2002, right?

Write to your Congressperson, and write to Congressman Barney Frank and Senator Carl Levin--they're the two in charge of investigations of what has happened since the banks and financial services companies were allowed to combine investment and credit operations under Gramm-Bliley-Leach (1999). The new "banking reform laws" stated, "conflicts of interest were allowed so long as they weren't abused," and it wasn't made perfectly clear how that little tenet was to be monitored and enforced. Let's just say it's clear to a number of us who have lost first a lot of savings and then got ripped off in credit cards and subprime mortgages which we used to "ride out the bad times" (which thanks to these guys weren't about to end any time soon) that conflicts of interest were abused and enforcement and restitution has been miniscule at best. It's not hard to understand once you wade through their annual reports for 1999-2002. They could make more money--a lot more money--from interest on credit cards and even subprime mortgages than from investments, even in China, and fees for brokering investments, "managing assets" and "investment/savinags accounts," and "investment advice." They knew who were 40-50 years of age with mortgages and dependents and thus were most vulnerable to cut backs in companies to "cut costs." It's time for investigations and some changes in Gramm-Bliley-Leach. It's also time to start asking the Justice Department (the U.S. Attorney General) why, since the successful federal suits against these companies (which own all the credit cards now in the U.S. except for Capital One)all took place after Sarbanes-Oxley, they didn't start prosecuting the executives and directors of these companies when they started balking at restitution to investors/debtors after paying federal fines. That wasn't supposed to happen, according to the federal suits settlement agreements.

By the way, guess who the friends of Abramoff, Ney, etc. and the "rangers and pioneers" for the re-election of Bush and Cheney all were?
