|
|
This is on my credit report as a credit card for $2703.00 Opened 10/2002 and in collection since 12/2005. This is acually a credit card I had charged off in 9/2000 with a ballance of only $900.00. I have disputed it with Experian and they said the company said it was correct. I then called LVNV and they verified the correct info but will not change it on my report or send antthing to me in writing to varify the account. Any ideas?

Did LVNV say the card was charged off in 2000? If so, then the last activity would have had to be in 2000 and it should be out of the SOL period, so you can dispute it based on that. LVNV is a very difficult company to deal with, read other posts on this site about them. You are going to have to send all correspondence to them certified return receipt, and document all phone calls.

David, did you call your original creditor and inquire about this account? They might be able to give you some information in writing about it. On the basis of it, you can file your dispute strongly.
collection agencies are violating the fdcpa laws if they try to keep negative information in the file intentionally. Write a letter requesting for valid account details.
As TMD said, do you know the date of last payment made on this account? If the account is past the statute, you have the legal rights to escape this debt. You need to dispute with them mentioning the expiry of the SOL period.
Do all your correspondences in writing through certified mail with return receipt requested. Keep copies documented in a file for records.
