The settlement company sends a letter to your creditors informing them that you will not be making any payments.
As you build money in your trust account, the settlement company begins to make settlement offers to creditors.
Thats the whole program. Not complicated. The difference between using a law firm and a settlement company is that:
Most states prohibit debt settlement unless you are a law firm or licensed. No settlement companies are licensed because they would not be able to charge the fees that they need to charge in order to remain profitable. Check the state statutes in the state where the company is located to see if they are liocensed or in compliance. Most states require that the debt adjustment company provide you with audited financials upon request. Florida is one of those states.
Law Firms have advantages:
1. The can curb debt collection abuse by dealing directly with the Attorney Generals in the Various States.
2. They can analyze a debt contract to see if the lender violated truth in lending laws.
3. They always have the threat of filing a bankrutpcy petition if the client cannot handle the debt collection activities.
The only disadvantage is that the Law Firm did not "sell you the service" the referral service did.
If you think that you have been mislead, contact the counselor that sold you the service. Remeber, the service is simple:
1. Creditors are contacted and told no more payments will be made.
2. When monies are sufficient to settle, a settlement is offered to the creditor and a settlement agreement is reached.
Thats it. Make sure that this is the service for you.
Make sure that the company you used is licensed in the state in which it is located. Look up the laws regulating Debt Adjustment/Credit Counseling in the State in which the Company is Located. Ask the counselor if the Debt Settlement Company is licensed, or in the alternative, ask the counselor why you are being placed into a "pre-bankrutpcy" program.
