I am possibly going with hess/kennedy, but read some bad info on them on a web site, seems there are a dfference of opinions on here as well, would like some input also some info on t & c or what the t & c stand for would be nice instead of keeping things a big secret and how to contact them, it seems if this site is to really help people then you could post how to contact these companies, or is this just a site to lead people astray ran by people paid to promote possible bogus companies

T&C phone number is no big secret. THis site has helped alot of people understand how to take control and deal with collection agencies and how to fight back against the pdls. No one on this site has ever lead anyone astray. THis site also doesn't promote bogus companies by any means.

Ok, so maybe I spoke in haste, I have just reached a situation where I am looking for any real help, could almost handle the credit cards, but its the PDL's that are breaking me, made the call to hess/kennedy today, also talked to T&C, but will go with H/K,payment schedule was more afforadble.
What do I do durning the time (3 months) before the place can act upon everything, mainly the pdl people, they will all be calling, and sending checks to bank, can handle the overdraft charges, just dont want them to go to any prosecuting phase for checks not being honored.

If you are hiring a consolidation company to handle your debt accounts, they will make sure that your payments reach to the lenders in the right time. You should keep a copy of all your documents in order to prove that you are taking care of the matter.

I've been lurking here for a few weeks, but finally have the courage to post here. I'm just so embarassed by my situation!

My husband and I have had financial difficulties for two years now. When I went back to college I only worked part-time. We took out payday loans to pay bills. And then we took out payday loans to pay the interest on the first payday loans. Lather, rinse, repeat.

I'm done with college for now and have a good job. We could really benefit from a debt consolidation service, but the ones I've called tell me that they can't or won't work with payday loan companies.

I'm very interested in getting ahold of T&C. I'm also interested in getting refunds from the payday loan companies that didn't adhere to my state's laws.

Does anyone know if T&C works with folks in Colorado?

Thanks to the powers that be for having such a helpful forum! I've learned so much already!

Hi Krussell, don't feel embarrassed about your situation. We can all relate with each other. Some of us who have seen things improving slightly leave a good imprint for us with their valuable suggestions and advice. And similarly, those who are not in a good situation like we find ourselves in, we can set examples for them. So, the best bet for us is to read such forums and gather adequate knowledge that can always be helpful. Many here have tasted success with the consolidation program and few have been able to get the refunds from some lending companies as well. We just have to put our steps in the right direction and move ahead. I am sure luck will favor us. You have done the right thing by registering in this website and taking the first step towards debt free. I am sure you will taste success sooner.

Welcome Krussell. Stick around and you'll find this is a very helpful place. Don't be embarrassed, we've (almost) all been there. We're here to help!! Smile

Thanks, GunsNroses and Sue, for the warm welcome. I just can't help but feel so stupid, you know? Both my husband and I were raised better than this! Smile

The company that this website referred us to doesn't handle payday loans. None of our payday loans are in default yet. I've been looking up Colorado laws and it turns out most of our loans have been extending our loans and charging and us illegally. I'm seriously thinking about sending letters demanding that they stop debiting our checking account. Does anyone know if that will automatically put us in default if we still have balances due? Will the payday loan companies start calling our references?

And do I really need to wait until I have 1500 points before I can get T&C's number? I'm very anxious to get going on this... I guess I could post stories about my cats or children or something... Smile

An interesting sidenote--the attorney general of Colorado apparently sued Quikpayday.com recently for illegal lending practices, and got a pretty large settlement!

Sorry I've hijacked this thread...I'd be happy to repost someplace else if necessary.

Don't worry! You will get all the help you need. Just stay with us for a while and you will read many good things here. The lender has to act within the legal lines even if there is a balance due after charging excessive amount. Since none of the accounts are in default, they cannot put negative remarks on it. First, pull all the latest statements and see how much payments have been done from your side. Compare the rates with the laws in your state and get the actual amount. If you have paid excessively, write a letter to the lenders mentioning the state laws and the request for a refund. Take the help of your bank also if it helps. They will dispute the debits directly with the lenders and give you quick results. Let us know the outcome.

PostPosted: Thu Sep 28, 2006 2:19 pm Subject: stopping calls from debt collections companies

First off I don't know anything about T & C. I have just signed up with Hess Kennedy & Company, and so far they have been very professional and courteous to my needs. I have also done tremendous amounts of research. The best tool I have come across from stopping collections agencies from calling you is to

1. hire a debt settlement company to work for you.(basically, you are hiring an attorney for you when you do this.)

2. read the Fair Debt Collection Practices Act.(FDCPA)
It states in Sec 805(a)

Quote:
"COMMUNICATION WITH THE CONSUMER GENERALLY. Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt-"

Then in Section 805(a)(2)of the (FDCPA) it states

"if the debt collector knows the consumer is represented by an attorney with respect to such debt and knowledge of , or can readily ascertain, such attorney's name and address, unless the attorney fails to respond within a reasonable period of time to a communication from the debt collector or unless the attorney consents to direct communication with the consumer."

http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm#809

***YOU HAVE TO TELL THEM YOU HAVE AN ATTORNEY OTHERWISE THEY WILL KEEP TRYING TO CONTACT YOU***

Hopefully those of you who hired a debt settlement company this will help with the collection calls.
