anyone ever dealt with legal mediation practice in fl

I'd be willing to bet Legal Mediation Practice never sent the dunning letter and, what's more, would not respond to a debt validation letter. I never received the first written communication from them, and never received a response to my debt validation letter.

I am also curious to know if they made any other threats to you; I'm sure they threatened to prosecute you for check fraud and/or internet fraud. I would ask them to send you a copy of the supposed check.

JCEMT is absolutely correct, get an attorney! You can find one at www.naca.net, or check at your local legal aide office. Also, file complaints with the FTC, your state's attorney general's office, and the BBB. You might also consider contacting Florida's Attorney General's office, as they are just now noticing LMP and their shenanigans. Maybe we can finally get these jokers closed down!

Most importantly, don't let them intimidate you! These jack-asses are grossly violating the law themselves!

+1 to the advice that JCEMT and Ron have posted. Seriously, get an attorney familiar with consumer law. What this CA is doing is way outta line, and you can hold them accountable for that. Based on what you've written, statutory damages alone would be enough to wipe out the debt and put some cash in your pocket. Start recording calls from these bozos as evidence. Also save any written or emailed correspondence, as the lawyer/court is gonna want to see it.

Most likely not. But a good lawyer can, and will. Another avenue you should explore is to pop over to our PayDay Loan Help forum on this site. You'll find a wealth of information there. Also, someone there will have a link to the MS laws that specifically relate to payday loans.

I will pay back theloan I took out. However, I got a call, this guy left me a message saying that they have made a desicion on my behalf. I called back but it was after their business hours. I left a message saying that I was returning Bruce Black's call. I asked for them to name the creditir they were calling on behalf of and to be prepared to let me know how they got power of attny. in order to make this decision on my behalf when they called me back...I'll be ready

That sounds like veiled threat of lawsuit. Make sure you record your call with them. If you need a recording device we have one available through this website. Just post back if you have any additional questions or comments.

My girlfriend who is dealing with these cats now (me really) is going to author a letter and email to every congressman and send to them I will assume this cost as to get these clowns shut down. I may even send it to each states Attorney general!!!

File complaints with everyone he has listed. It is the only way we are going to get these idiots shut down!

Also, soontobedebtfree, I would call LMP back and ask them for the copy of the power-of-attorney that allows them to make decisions on your behalf. See how they respond to that.

Also, soontobedebtfree, I wouldn't be too worried. The first time LMP called me, I think they injected that phrase into the phone message they left for me, along with other misleading and illegal verbiage. That was when I requested validation and for them to cease and desist contact with me by phone, only by mail. A month later, in violation of the C&D, they called back and left a message again stating they had come to a decision on my behalf and wished me luck. This was done twice.

So, I made a decision on their behalf and hired an attorney to sue them for violating the FDCPA. I had also kept copies of the phone messages along with a copy of my letter, and proof of reciept (fax confirmation).

They settled out of court.

So I wouldn't be too intimidated by any decisions they may have reached on your behalf.

Have a recorder to record their conversations now Thanks radio shack. I have even gotten myself into the habit of stating this call may be recorded when I answer my phone as has my girl. All my friends think I am crazy but I gotta protect myself!!!

Yeah, I'd wonder too if I were a friend of yours and you kept giving the recording disclaimer whenever I called you.

But if you do live in a one party state, you don't have to let the caller know you're recording them. Only one of the participants of the phone conversation (you) has to be aware and agree to having the phone conversation recorded. Unlike a two-party state like I live in (Floirda) that requires both parties be aware and agree.

Which kind of defeats the purpose. If the @$$-clown knows he's being recorded he's not going to resort to the shenanigans that required you to have to record the call in the first place. Defeats the purpose.

So that means: you do NOT need their consent to record phone conversations. You need only the consent of one party involved in the conversation. That may be you. Very Happy
