anyone ever dealt with legal mediation practice in fl

In many states, writing a check for more than $500.00 that ends up bouncing is a felony. While a collection agency can't press charges against you (it is 100% against the law), the company that actually loaned you the money can, and they should.

see my previous post. In Florida, if you write a check (even to a PayDay Lender) for more than $150.00, it's a felony. Again, the Collection Agency -in this forum Legal Mediation Practice-can't press charges, but the person / company you wrote the check to can and should. Florida Statute, Section 832.05 (4)....832.10, section 5 further clarifies that even if the debt is placed with a collection agency, this does not prevent THE STATE ATTORNEY from prosecuting the person who wrote the bad check to begin with.

Florida Law (chapter 832.10 (5)) stipulates that even if a debt for a bad check is placed with a collection agency, it shall not affect the authority of the state attorney to prosecute any person for any violation of s.832.04, 832.041, 832.05, or 832.06...
832.05 stipulates that if you write a bad check for more than $150.00, it's a felony...less than $150.00 it's a misdemeanor. Either way-if you've written a bad check, you've committed a crime, and yes, you can be prosecuted and thrown in jail.

OK, so where are these bad checks in question then?

Does this same law apply to cash advance companies that "require" you to have their payments automatically deducted from your bank account? Even after you have already called the company in question, advising them you have no money in your account and not to try and deduct their payment, but they do anyway? Overdrawing your account to the tune of a couple hundred dollars, due to multiple NSF fees because the didn't try just once, they tried again and again? This is an ACH, not a check. So if it's so quick and easy to prosecute these alleged bad check writers, then why don't they just go ahead and do it? Probably because there is absolutely no check in question, and they have nothing to back up their claim of the debtor knowingly passing bad checks? It just sounds much more intimidating to falsely and illegally accuse someone of knowingly passing a bad check, hoping it will intimidate them into paying.

Besides Il-legal Mediation Mal-Practice is soon going to get it's behind spanked by the Florida Attorney General's office for just such illegal collection practices. So they probably don't want to draw any more attention than necessary to their chicanery as they are the ones willfully breaking the law.

THESE PEOPLE OF LEGAL MEDIATION PRACTICES NEED TO REALLY BE PUT IN THEIR PLACE. IT REALLY IS ASHAME WHEN YOU SEE HARD WORKING PEOPLE BEING HARRASSED BY IDIOTS LIKE THIS. MAYBE IF EVERYTHING LIKE TAXES OR GAS OR EVEN FOOD WAS'NT SKY ROCKETING UP A WHOLE LOT MORE PEOPLE WOULD HAVE EXTRA MONEY IN THEIR POCKET SO THAT THEY WOULDNT HALF TO BORROW MONEY. LORD HELP US ALL WHO KNOWS WHAT THE WORLD WILL BE LIKE IN 5 YEARS.

Evil or Very Mad LMP contacted my wife yesterday stating that she had until 12pm local time to pay the debt or be arrested. If you ever get threatend by this or any company contact your states attourney general and file a complaint. If enough of us do this this company will have to clean up there tatics or be shut down. The name of the guy that called my wife was "John Lomax" if this is his real name or not when i called him back he said he was going to file harrassment charges against me.

Eugene, sorry you and your wife had to go through this. I would love to see "Mr. Lomax" file his harassment charges against you, you already have him on a few FDCPA violations as it is.

In addition to filing complaints with the FTC and your state's Attorney General's office, be sure to also file them with Florida's Attorney General's office.

they are just collectors using desperate attempts to collect money. i use to work for allied cash advance and had to collect debts. they only call your family members before they call u as a way to embarrass you. they figure u don't want your family to know so they tell them anyway. when u took out a loan, u signed a confidentiality agreement that they are now violating. don't be manipulated or fooled. pay when u can, but don't lose sleep over this.

Thanks for the filing complaint info! I continue to receive calls regarding my neighbor's financial problems. This time it was Legal Mediation that called and actually harassed me regarding my unwillingness to contact my neighbor regarding this issue. File a complaint already!

This is a total scam. The only way that you can go to jail for not paying a debt is if you promised to do so in the property settlement agreement of a divorce. Debt Collectors will say ANYTHING to get you to send them money. They will say things like, "You are going to Jail" or "Doesn't your family care about you enough to give you the money to pay off this debt". It's ridiculous, but it happens. Don't let these people get you down, just mention a hiring a lawyer to represent you in this matter and I'm sure they'll get off your back.

It costs about $2,000.00 to go after someone for a debt that you believe they owe you, so they aren't going to spend that kind of money to actually try to collect from you most likely. That's why they resort to harassment. Good Luck All!!

They called my sister looking for me, his name was Jack, then I called back and talked to his supervisor and I told him I tried making arrangements to pay this and they wouldn't do it, so whatever and then he said that's what your statement will be then, "WHATEVER". These people are so irritating. And yes it scares me because its a payday loan, but I had another payday loan place actually take me to court on a matter of the same effect but they couldn't do anything because I am under poverty level.

Welcome to the community Ms. Beck.
Please be mindful that debts are civil matters not criminal. You are not going to be arrested. Legal Mediation Practices appear to have a very bad history of making unlawful threats of arrest and incarceration. Depending on what state you live in you may be able to record their phone call without their knowledge and use it as evidence to submit to your state Attorney General's office as well as the Federal Trade Commission.

Sorry, I don't know who these people are, but they are very rude and unprofessional. They have been contacting me in error regarding someone I don't know and when I try to tell them I am not that person (which is a male) nor do I know that person, they treat me as if I'm an idiot. I'm pissed because I have no way to stop these idiots from calling my cell phone number for the person they are trying to contact. I would love to get an address for these folks and write to whoever's in charge to insist that they check their facts, update their system, and stop calling my number! Oh, and let's not forget that they really need to learn how to talk to people! The persons I have to are a Mr. Davis (he was polite and apologetic) and a Tom Law (the biggest ---hole I have encountered)!
