Default Harrassing Phone Calls

Document the date, time and number of person who called you. Send it to the FTC. AS for when you say to stop calling, verbal won't get you anywhere. Take from someone with experience. The only way it becomes illegal is if they call you after they have already received the C&D letter you sent them--send it CERTIFIED mail. It gets a signature that way and you know they got it. WOrks every time!

Wolfsong the 201 number is from a company called Dial America. They are a magazine subscription thing.. They are calling me because a couple years ago I ordered a magazine from them with donations going to Mothers against Drunk Driving. So chances are thats who that is..

The number 866-266-6600 is for Asset Acceptance. They are a collection agency.

They have continually contacted me looking for someone who DOES NOT LIVE HERE! I have asked several times for them not to call me because I don't know the person they are looking for.

If you receive a call from them, tell them to stop calling. File a complaint with the State Attorney General for violation of the Fair Debt Collections Pratices Act (fdcpa).

Hi Jesse. Good girl. Thanks for your input. I am registered with the national do not call list. Home and cell phone. I have received a phone call from the above and have filed an online complaint with the FCC about them. Google DO NOT CALL and file a complaint of your own. Go get em girl.

Default Debt collector

The number 866-266-6600, is from a debt collector, I got an automated call from this number and it identified itself as Brian Andrews from a debt collector, and to call back at this number, a machine calling itself by name, lol

I called this number back and they couldnt even find me in their records, not by the phone number nor by name, told them to put me on a do not call list and if I receive anymore calls, I will file a complaint with the states atty general, the bbb, and anyone else that I can file a complaint with.

Default Creditors and the law..

IF your debt is 7 years old debtors cannot collect. Statue of limitations. Remember this...if you agree to begin paying on a debt after talking with a collection agency and you send a payment that 7 year period starts again. First of all DEMAND a copy of the original contract which has your name on it. THEY WONT have it. Unless they can come up with the contract they don't have a leg to stand on. And remember the 7 year clause. Secondly do not admit you owe the debt. If you call never say you owe the debt. Just inform they you received a call and you are unaware of what they are talking about. I'm not saying we shouldn't pay our debts but sometimes things happen and we can't. Use a calling card to call the number of the debt collector. Don't give them ANY personal information.

Expiration of SOL does not extinguish the underlying debt unless you live in MS or WI as they have a Statute of Repose.

You are confusing SOL and reporting period. Reporting period starts with the Date of First Default and can only be reset by bringing the account back to a current status with the OC and then defaulting again.
