December 2005 I called about my accounts not being paid the month of December in January of 2006. I could never get anyone to answer my calls on one phone number that I had for Credi-Cure and the other phone number that I had would tell me that the number was no longer in service. In a statement made by Richard A Brennan on a this web site posted September 7, 2006. Mr. Brennan stated the problem with my account and other people’s account only quote, “come to light when his law office stepped in and began correcting the accounting issues from Credi-Cure.†This statement is false due to the fact that Mr. Brennan is the one who returned my phone call for Credi-Cure on January 5, 2006. I know this date because it is still on my caller ID with the Law office of Richard Brennan and is dated 01-5-06. Mr. Brennan stated that the office of Credi-Cure was moving to a new location and was late making my payment for the month of December 2005. Again in February of 2006, my payments were not made again by their due date. I called again and I was told that they were still behind where they had moved. My payments for03-06 – 05-06 were made on time.
On June 28, 2006, I had back surgery and was home on the 29th when I stated receiving phone calls from my creditors that my payments had not been made for the month of June. I had to start calling again to Credi-Cure and was finally able to reach someone after 3 hours on the phone tracking down different phone numbers and was told to call the law office of Richard Brennan. The customer care person that I talked to that day was Natasha. She stated that the problem was due to some credit card customers no longer taking electronic payments and they had to send a paper check and this caused all my payments to reject. However, she stated that payments were made . Natasha was told by one of my creditors that the Law office of Richard Brennan had mailed my payments for two of my credit cards to the wrong address. Natasha was told that the New Mexico office was for negotiations only. She was told the correct address to send payments to. Natasha stated that she would have to wait 30 days before she could trace these two checks and stop payment on them to have them reissued.
I called Natasha every Monday and Thursday of each week to find out what was going on with these payments. Natasha only returned my call one time during these three weeks of calling. However my payments were made for June 2006 on July 22, 2006 for all of my other creditors. The payments for July 2006 were paid to all of my creditors on July 29, 2006. This still leaves two of my credit cards missing a payment for the month of June 2006. This amount totals $424.00.
In August of 2006, an electronic withdrawal of $607.00 was taken from my checking account (the same amount that had been withdrawn from my account since May of 2005 by CrediCure) and always on time and the same date unless it was different due to the law office changing the withdrawal date, which should have been the 10th of each month. August withdrawal was electronically taken from my checking account by the law office of Richard A. Brennan on August 14, 2006. As of October 28, 2006, the August payments to all of my creditors have not been made. This payment that was taken out of my account in the amount of $607.00. This bring the amount that is owed to me $1031.00. This does not included the amount of the first payment ($607.00) which later was told to me by Tiffany, a customer care representative at CrediCure that this was not my first payment but a deposit. This “deposit†was to be kept until my last payment was due in case I defaulted my contract, which I did not. Nowhere in my contract does it state this. I did not find this out until the creditors started calling me in June of 2005 and asking me where was my first payment with Credi-Cure. This is a Grand Total of $1638.00. In the contract it states that I am to be given a 15 day notice of any changes that affects my contract with Credi-Cure. On August 27, 2006 I received a letter from the law office of Richard A. Brennan stating that I may not be aware of the closing of the office of Credi-Cure in February of 2006, this is six months after the fact.
At the end of August 2006 I started receiving phone calls again from my creditors stating that my payments for August 2006 were not made again. I called and talked to Nikki, a customer care representative at the law office of Richard A. Brennan, and told them not to take anymore money out of my checking account, that I was giving my three day notice as it states in my contract and asked where my payments were for the month of August. Nikki stated that the office was short staffed and behind sending the payments out and assured me that my payments were going to be made. Nikki also stated that she could not take my request by phone, that I would have to send it in a letter. However, that very day I went to my bank and had the proper paper work drawn up to stop any further withdrawals from my account in the amount of $607.00 from the law office of Richard A. Brennan. I also sent a certified letter to the law office of Richard Brennan requesting all withdrawals as of September 1, 2006 to stop being electronically taken from my checking account. This letter was received, signed, and dated on September 5, 2006 by an employee of the law office by the name of K. Gayle. I started calling Natasha and Nikki again and asked them where my money was for the payments of August. The first of September 2006, I received a letter dated August 31, 2006 from the law office of Richard A. Brennan asking me to sign a representation agreement and send them $1500.00 to save me 50% off of my outstanding balances. A couple of weeks later I had a message on my answering machine to call a man by the name of Andrew asking me to sign the paper and send it in, in order to start working up my proposals towards my creditors. The number that he left was not a valid number. After receiving this phone call and the representation agreement stating what they could do for me, I saw that they were just wanting more money and had no intentions of refunding my money.
As of October 28, 2006, I have talked to and left numerous messages for Natasha, Nikki, Sulma, Mike (office manager) at the law office of Richard Brennan, with no response. I have also left messages at ext. 116, 126, and 238 which Sulma stated to me was her office managers extension per our last phone conversation, and that was on October 16, 2006. On October 10, 2006, I sent an email to Sulma at a yahoo address that she gave me per our phone conversation and emails to info(at)rabrennanlaw.com, and payment.issue(at)rabrennanlaw.com. stating everything I have written. I have asked the law office to send me my money not to my creditors, due to the fact that my interest rate has gone from 6 and 9% to 27 and 29% and late charges for each month. I am now working with a new debt management program called Consumer Credit and they are trying to clean up the mess that this law firm has caused. As of October 28, 2006 I am having trouble with at least one of my creditors wanting full payment of the balance due. This is due to the fact that it looks as if I have defaulted and was dropped from the program and was not making my payments. I have done everything I know to do and I have called and waited patiently since July 2006 but have not gotten a resolution to my problem yet. The only reason I went on this program was the fact it was under the name of Christian Finance and I checked the BBB and they had an outstanding rating as of May 2005. I would like to state that I am not a person who went out and spent her money foolishly or did not care who she owed. I lost my job after 19 years at a company that closed its doors in our area. Within a two year time frame 5,000 people in our area lost their jobs. Four months after losing my job, my daughter lost her job. Four months after that, her husband lost his job, and two months after that, my husband lost his job. We went from an income of approximately $75,000 a year to both drawing unemployment. My daughter and her husband lost their home and moved in with us. There were no jobs in this area for me or my daughter and we had to go back to college under the trade act agreement. My husband was out of work for six months and I was out of work for two and a half years. However after my first year in college I lost my trade act unemployment due to the fact I had never been laid off in 19 years and didn’t qualify for full benefits. I could not quit college because I would have to pay my first year back to trade act and therefore had to complete my education.
I received a letter from the law office on November 3rd telling me they would no longer be helping anyone in the state of Virginia and was referring me to a new conselor by the name of Consumer Alliance Processing Corporation. However the propasal was to pay them $445 a month but they would be withdrawing $607 a month from my account. I called this company and warned them that if they touch my account I would sue them. I also asked them where was the $162 dollars of my money going to? Sounds like they are a bunch of crooks also. We all need to get in touch with a large news agency to see if we can get some help. Someone like CNN, CBS, NBC, & ABC.
Richard this message is for you: How do you sleep at night knowing that you have taken advantage of so many hard working people? Oh but that is right you are a LAWYER!! who thinks he can get by with anything. Think again someone will help us it will just take a matter of time. It might not be today or tomorrow but someone will help us.
