I am in official payday loan default

Tell them to tell you what time the cops are going to show up so that you can have your bank statements ready to show them, and then you'll send the cops over to their house for their turn..lol

They can't have you arrested for that. They're lying to you.

Tell them to leave you alone or you'll file a complaint with your state attorney general's office for overcharging your interest...And if they come back for more, FILE the complaint. There's nothing they can do to you.

That's correct. Being default on a loan is not a criminal offense. Writing bad check could give one some trouble, but post dated checks are never counted as bad check. So relax, you won't see police at your door.

Most of the payday loan companies break the usury laws of states. Are they internet lenders or store front lenders. Do you know if they are licensed to do business in your state or not?

If you haven't already, think about closing your checking account and re-opening another. They will continue to debit your account otherwise. Then contact them..Be firm, don't let them scare you...And make some arrangements with them. Or, if you want to consolidate, register and someone will pm you info

Have you filed a police report regarding the theft of the $1950 from your account? This should be your number one priority, filing the report. After obtaining a copy, send that over to your branch manager at your financial institution, as well as filing a complaint there.

Also, regarding Arrowhead Investments, send them a cease and desist letter along with a copy of the police report. This will show that there was fraudulent activity on your account.

You might also want to call the place where you first took out the loan, and explain the story to them. Tell them you have everything documented.

When all the money is placed back into your account, you will have your payroll check to pay back the loan.

hello I declared bankruptcy because I fell behind with all my bills trying to repay the payday loans. Now one of the loan companies have threatened to have me arrested for bank fraud and bank by diception. I gave them my bankruptcy case # and the attorneys phone # but they said they were still going to charge me. Does anyone know if this can happen while in bankruptcy?

PL, which type of bankruptcy did you file? Chapter 7 bankruptcy discharges all the debts filed under it. The creditors are therefore not allowed to collect the money after the debt is discharged under chapter 7. Inform your attorney about this action of the lender.

PL, If you filed chapter 7 payday loans are discharged. They will threaten you with everything. Dont fall for it. You are under bankruptcy protection. If they call you more than three times total they will have to answer to the judge. Inform your attorney because they are not to have contact with you. Good Luck KYSIDE38

Chpt 13 is the same way, if the creditor doesn't file a claim by confirmation then once the Chpt 13 is completed they can never collect the debt, it no longer exist. The only debt you come out of a Chapter 13 owing would be federal studen loans.
Can anyone let me know what to expect from VC FUnding, XPRESS Cash/DMS Marketing, ASAP, and Cash Supply when I default on the loans tomorrow.Will they call my co-workers? Boss? I work for the state and I know my boss will not respond, they won't even be put through my boss, but co-workers always love good gossip. I'm waiting for T & C's contract to come in the mail to sign and send my payment to make the consolidation official, until then I need a heads up on how much stress I'll be dealing with. Thanks for the help! Amy

Most payday loan companies do not even know you defaulted until 5 days after. They cannot call your co workers due to the privacy act. I pulled that on one of them as they called and left a hateful message on a coworkers voicemail with the same last name as mine. THey never called me back once I contacted them and told them what they did and that I kept the message the co worker forwarded to me. Just monitor your calls at home and advise your boss that you have a legal issue and do not want to take any calls at work. Or contact them now before they know you defaulted and advise you are not allowed calls at work. They are not allowed to call you after you advise of this. PL

I have gotten myself in so much trouble. I have been reading the terrible stores on how these pay day loans are a dept trap and they know it. My story is so like alot of them I read, but now I'm in dept and almost my whole paycheck is gone every two weeks and I don't know what to do. I keep making more loans to cover my dept and now I'm in really bad and need a bigger loan to cover them. Does anyone know what I should do? Will I go to jail if I close my account, loose my job, license anything else. I will be glad to pay them off but I can't like this HELP ME SOMEBODY

Eyvonne, what state are you in? Are these storefront or internet pdls? Who are the companies? And how long have you been paying on them? If that wasn't enough questions here are some more: Have you placed a stop debit on your account with them, or have you considered closing that account and opening a new one? That is the first step in taking back control of your finances and taking the control away from them.
