you can write a letter telling them they are not to contact you at work or at home and to do so is in violation of the fair debt collections act and will be considered harrassment. Send it certified mail.
Each occurrence violating your request is ammo to build a harrassment case. They will stop calling you.

okay, made arrangements to pay the full amount to LMP and last payment is do to come out on the 18th. I am sending letter tomorrow registered, return receipt etc. Should I go ahead and either change acct number and/or tell bank not to authorize/allow any payment for specicif amount or to the name they are using?

Just realized I wasn't logged in! just saw a post by goudah in the payday loans forum about it. Does it help that the debt isn't actually mine and I did not actually authorize the payment myself

If you did not authorize the payment then they have no right and the debt is not yours then they have no entitlement to monies in question.

okay so I have cancelled the card they had info on. Bank was very helpful on this. So should I contact and let them know or just let it carry out.

Don't worry about letting them know. If the debt isn't yours the validation letter should take care of them. You might want to check your credit report to see if they have reported it. If they have dispute it with the credit reporting agencies as it is not yours. If they refuse to remove it then you can sue LMP as well as the any credit bureau that doesn't remove it.

Okay card cancelled acct # changed. DV sent I know they will call my girl as soon as the payment does't go through and advice how she should handle these rude people? The ladies name I believe is Brenda!

Tell them you have something in the mail for them. Once they receive the DV letter they will have to validate first. If they contact you after you get the signature card back from the certified letter but before they provide validation, simply remind them of their legal obligation. Per fdcpa once you request validation they must cease collection activity until validation is produced.

Well they have received DV as it was delivered Jan 17th at 9:58 am! Final arranged payment was scheduled for tonight I am sure my girl will receive a call from these wads tomorrow gut feeling.
in my rush to send out DV I thnik I may have misworded, will this make a difference? I followed a template from this website but I forgot to customize to my girls situation. any thoughts?
