Google legal mediation practice, and you will find that they are being federaly sued. Don't settle, take them to court. You will win, and the amount will be a lot more than your thought. They will just want you to go away so they can continue in the collections field.

miked0789.
The more appropriate question might be: How many consumers actually now their rights under the fdcpa, and how many CA's are counting on the fact they don't?
I think most consumers are not educated enough in the FDCPA to even know their rights have been violated. Or too embarrassed that they are in debt or behind on their bills, in the first place, to file a complaint or seek out legal representation.
That's why I'm glad this Forum exists!

We are planning on taking Legal Mediation Practice to court for harrassment. We experienced threats of jail time and accusations of fraud from these folks. We were also told that a payment arrangement was not allowed. We told them to bring us to court so that we can file a counter suit and they can then owe us the money. These payday loans are a major financial nightmare. We had every intention of paying our loan but ran into a very tight siutation. We told them our circumstances and they infomed us that we intentionally stole money by not paying back the payday loan company. We plan on pursuing this to the fullest extent of the law.

I'm with you 100% I just a call from them today, and they did the same thing. I knew right away that something didn't sound right so I called up a few friends and they all said the same thing, that they're full of crap and it is illegal. I did some research online and that's how I got this forum. It's not over for me unfortunately, I have alot of things on my plate right now so I can't really pursue this at this very moment. But they just barked at the wrong tree. They are in big trouble this time.

Guys, if these @$$-clowns are using the illegal tactics you say they are; strike back! I'm not saying, and I don't think anyone else on this site is, you shouldn't pay your debts. You are, however, entitled by law to be treated with dignity and respect by Illegal Mediation Practice no matter what or how much you owe. Being unable to pay a bill is not a crime!

My suggestion is to record, if you are able to, all messages left on your answering machine by Illegal Mediation Practice. I'd be willing to bet there are already a few violations of the fdcpa on those alone. Also, if you are able to record phone conversations (check the laws in your state regarding this), be sure to record any and all you have with LMP. I'm sure you will catch some more violations of the FDCPA. Take pictures of your caller ID that have the dates, time, and phone number LMP called from. This would all be helpful evidence if you decide to sue.

Make sure you send a DV letter, and C&D if you don't want them calling you any longer, to LMP CMRRR. I'd also bet the horse you will never receive anything in writing from LMP. They are required, by law, to send written notification of the debt to you within 5 business days of the initial contact. Well, it's been months now, and I have never received anything written from LMP, just harassing phone calls after I C&D'd them. That's why I sued them.

File complaints against them with the FTC, BBB, and your state's AG's office. I cannot believe these jerks have not been shut down yet.

The best advice I can give is to know your rights and understand the FDCPA. Read, read, read, the FDCPA as well as the forums on this site and be armed with knowledge so you can deal with LMP. Don't ever let them scare you or intimidate you.

I almost forgot.

Please don't let Illegal Mediation Practice prejudiced you against people from Jacksonville, Florida. I've read of a number of shady CA's, LMP being one of them, that are based in Jacksonville. Not everyone here is like that, especially me.

Out of curiosity, I map-quested them and drove by their office, I just wanted to see where they were located. I didn't see their name obviously listed on any door (there's probably a good reason for that) and I was afraid to pull into their location and get too close; they might think I'm stalking them and call the Po-Po. I'm sure they've had people waiting outside their doors before, given the way they treat people. The building is old and pretty shabby and run-down; they must be getting a good break on the rent. The funny thing is, they are pretty close to a Church; pretty ironic, these unholy jerks so close to a Church.

<<Sigh>>

Pitomate,

Not to belittle your experiences; however, I'm pretty certain there is more to your story than we're getting.

If these Bozo's were going to get you for "bad checks" you would already be "got"! They're not going to call and warn you they are going to sick the po-po on you. "Yes Mr. Debtor, the police are on their way, so you wait right there!"

Right

These dumb-@$$es are violating the fdcpa by even threatening to have you arrested. Illegal Mediation Practice is probably collecting on a Pay-Day Loan, you cannot be arrested for being in debt and unable to pay; it is a civil matter and not a legal matter. You can, however, probably be arrested for writing bad checks; however, I would ask Illegal Mediation Practice to fax, or mail, copies of those checks to you so you can see them. I'd be willing to bet they would never materialize because they probably don't exist.

LMP is using every illegal tactic to get people to pay them money, and I'm certain it works for them most of the time. I had my own experience with LMP and was threatened with the Police (among other things), months later and I'm still waiting for them. I even got an attorney and was ready to sue them for multiple violations of the FDCPA. Guess what?!? They settled out of court. They probably didn't want their sorry @$$es dragged into court as they would have probably had to pay a lot more when they lost!

They are idiots and don't ever let them intimidate you. Learn, from this site and these forums, about the FDCPA and your rights. Send LMP a debt validation and cease and desist letter. I would be willing to bet the farm you will never receive anything in writing in response to your letter. That's a violation of the FDCPA right there; one to get you started. Collect them, share them with your friends, and when you have enough collected: sue the poop out of them!

I sent the DV and C&D letter to them and, months later, I'm still waiting for a written response.

I just wish I could afford to take out an advertisement on prime-time network TV and warn people about these bottom-feeding @$$-clowns! They really irritate me.

Corky, record these calls. Check your state statutes to see if they can be recorded without their consent, if it needs their consent start recording and tell them that the call is being recorded and if they continue to stay on the line that it will be consenting to the recording.
