Guest they have five days from date of first call to mail you a validation notice letter.If they fail in doing so,they have already violated fdcpa. Here is their contact info from buddhibbs.com.

Hey sidekick, do you have a mortgage? Or how about a car loan or any other kind of loan? Do you have credit cards you use? If you do then you are a debtor yourself junior. So you might want to be careful before calling yourself a deadbeat.

I just got a "message" from this company, they did not identify themselves on the message nor would they do so when I called!! Other than to say "ASG" When I gave them the "reference number" they had left they proceeded to tell me about a credit card debt I didn't have. Very very rude at every turn, yet not willing to give any pertinent information. I'm quite sure they have the wrong person, as I have no outstanding debt other than student loans. They even wanted my social security number before they would identify themselves!! this is legal?? please!!

Perfectly legal.
Third party disclosure is a violation of the fdcpa, that rep was following the law

ok look, maybe you didnt get enough flogging last time around. That why youre still here, posting ridiculous things like this and not having a clue?

Tell me something--IF SOMEONE LENDS YOU MONEY, HOW CAN THEY REFUSE TO PAY YOU BACK? If I lent you money, shouldnt YOU be the one paying ME back? Go back and reread your post again....and then tell us why you fail at basic understanding.

Second, and I dont personally care whether you like it or not, this country was founded on the premise of INNOCENT UNTIL PROVEN GUILTY. Do you even know what that means? It is really rather simple--

1--you accuse me of owing your company money.
2--I deny the accusation.

At that point, THE BURDEN OF PROOF IS ON YOU to prove that you have a legitimate case. It isnt up to me to prove your case for you. And yes, while I am fully aware that this allows some guilty people to get off scot free, it is also designed to protect the innocent from having just anyone come along with any accusation they please.

When YOU claim that I owe you money, YOU are responsible for proving it. Dont like that? I dont care, its the law. And hey--if you cannot legitimately prove that I owe you money, THEN YOU DONT HAVE ANY RIGHT TO GET THAT MONEY. Sure, many people really do owe the debts. Hell, there is a guy that just posted recently in this forum about trying to skip out on a debt by moving right across the state line next door, where that state's SOL is already expired on his debt. I told him to stop trying to scheme and pay his debt, because he admitted that he knows it is really his. I am not here to tell people to skip out when they know its legit, but YOU have the obligation to prove it regardless. If you cant, then go cry your river elsewhere.

By the way, can you lend me money? I promise, I wont ever make you pay it back.... :roll:

Hey sidekick, I'll tell you what. If I lend you money, and you don't want to pay it back, I would already know where you live, and a loan between 'friends' is not covered by the FDCA. Broken knee caps or a judgement in court are all the same on the street. Wanna borrow 100 bucks?

Default ASG goes to India - complaints continue

I am experiencing the same problems. I know that I have no outstanding debt to anyone... and, I'm not going to identify myself and confirm who they are looking for. I once identified myself to a debt collector trying to collect a debt owed by my ex-wife (we'd been divorced for 18 years)... they didn't care and harassed me for 6 months trying to collect her debt.

I've told ASG to stop calling 23 times (since I started keeping a log)... Even after telling them this, they persistently keep trying to get me to confirm my identity. I've told them I never heard of the person. They tell me they can't take me off their list unless I give them my name. I told them my name was Bob... they still call.

All of those who called have and Indian accent and Indian names.

The problem with filing a complaint is that I must identify myself...

Anyhow, I'll try Native2's suggestion when they call tomorrow.

File the complaint with your state's attorney general's office, that way your personal information is concealed.
