My question is about a negative on my credit report,It is from alltel,They are claiming that I ordered a cell phone online in 2002 and owe them 352 dollars.I have never owned a cell phone,and have disputed this with the CRS many times this past year.I wanted to know what this would fall under as far as the SOL is concerned.Is it like a credit card or written contact,just curious,since I dont think that they are going to take it off.I reported it as fraud,but they have now sent it to a collection agency.What do you think?

Did you ever apply for the cell phone? It seems you had a deal with them in past and then cancelled it. If this is the case, did you sign any contract or enter into a verbal agreement. You can consult a lawyer for this.

This is so weird to be harassed for the product that I never had.

No,I never applied for a cell phone,but I use to sign up for surveys and freebie sites,not to mention the payday loans,I am afraid that someone else used my information.I asked them to send something showing that I received a phone,since if I had,I would have sent it back,but they said that they couldnt do that.

I would file a complaint with your state's attorney general's office to research the matter further. I had something similar happen to me in the past with a different cell phone company that I did not use or even apply for. I tried calling them and they refused to listen to me. I ended up listing it in my bankruptcy four years ago just to be on the safe side. Of course, I didn't know about the different laws then either.
