I am glad I am not alone. These people call me on my business line several times a day. I actually have excellent credit and just got copies last summer of my report from all the agencies. Each line item said that I have never been late on a payment. When I try to call the phone number back that they are leaving on their message, no one is ever there. I have had this phone number that I only use for business for about 8 months. They have never called me on my actual home phone number which I have had for many years. I think they must have the wrong person. Either way, they need to stop calling.

Have you ever spoken to them? Ask them who they are looking for? If they are trying to get in touch with a person you do not know, tell them not to call you. Send them a cease and desist letter through CMRRR. They should stop calling you once they receive this. You can mention that you would like to receive mails rather than phone calls in future. |

Out of the blue I this week received in my home mail "formal notification" from Allied of an alleged debt of $4,000+ due to "US Department of Treasury, FMS allied interstate, Atlanta." After three phone calls to Minneapolis I was stunned to "learn" that as of November '05 an "account became overdue" for repayment of a supposed "signing bonus"; these to me fictive claims I presume are meant to relate to an uncontracted civilian stint as a prof at West Point during academic year 2001-02: the original creditor is given as DoD, the position I within my rights resigned, and I've had no other business with the military before or since. I've read the detailed advice above concerning dispute, validation, and credit reports, but would like to ask about that statute of limitations, and any pertinent general advice you might offer. Thank you!

As to Statutes of limitaions, every state is different. Google the term and see what it is for your state. For example in Texas it is 4 years across the board, in Tennessee 6 years. But if your date is Nov 2005, I'd think that it would be in statute anywhere.
As to Allied, beware. Look at their record on such sites as Bud Hibbs or ripoff.com. |

Sorry, I forgot to mention. As to government debt, in most cases there probably isn't a statute of limitations, such as for taxes or student loans etc. In looking at the fdcpa, I noticed that most government debts are not even considered "debts" under the Act. They are "debts" which can last forever.
But, I would certainly send them a letter to demand of verification of the "debt" (ie., demand that you have some contractual obligation to pay them). This could be to your benefit. |

Thanks for the response(s). I was considering writing a certified return receipt dispute letter to Allied--I have absolutely no documentation on any of this, and have received nothing from the government, Treasury or DoD. I suspect the government of harassment already, though I'm aware of their capacity for error. |

Sonny: Send Allied debt validation letters on those three accounts. Dispute them with the Credit reporting agencies and if allied does not respond to your DV or does not respond fully, take them to court over it.

forget that--take them to court anyways for three violations of the fdcpa. A report to your credit bureau is communication, as defined by the FDCPA, and within five days of that initial communication they must send you written notice of your rights under the law. Obviously they didnt do that, and those three violations are worth $3000 in your pocket....

OK. We had our income tax return intercepted for a defaulted student loan of my husbands (the tax return taken was 5,900.). Sallie Mae says we show 0 balance with them and referred me to United Student Aid Funds. I had a run around with their automated system, but, got referred yet again from there to Allied Inc. Here is the kicker.... I contacted them. I wanted to resolve the issue before the next income tax return. They were very nice and we were working out a payment plan over the phone. I had agreed to pay $60 a month on the balance. I was stupid and gave my debit card numbers out over the phone and my husbands place of employment. I had agreed to start making those automated monthly debits. He said he would send me the paper work to get started and to fax them back quickly. They emailed them to me. I print them and then read them. NO NO NO. They put no balance. They put what my monthly payments would be on there but not how many of those payments and when they would end. I called "JAKE" back and asked for better paper work. I would not be signing these. All I asked for was more detailed paperwork. It turned ugly...... so my questions are (1.) Can Allied garnish my husbands wages? (2.) Since I gave my debit card numbers to him can he deduct whatever he wants for eternity?.... (3.) Are these guys legit? (4.) What do I do?
Debb I am going to send the certified letter and am trying to speak to a human at United Student Aid funds (my credit report shows united student aid funds as having it tho they say they dont. On the report it only shows Allied as "Regular Inquiries" HELP |
