I started getting phone calls from Arizona last week. I couldn't figure out exactly where they were coming from. They would call and not leave messages. When I called the number back, I found out it was allied interstate. I printed off my husband's credit report today from Equifax, and guess what I found? They reviewed my husband's credit profile the day before they started calling my house! I don't know who these people are, or why they're calling. I have no written notice from them. Thanks to lots of surfing on this forum today, I have a game plan for the next time they call back (demand written proof of debt, etc.). What I want to know right now is- how can they access my husband's credit report under the guise of being a creditor when they're not, and they have NO written permission from him whatsoever?

A collection agency can put inquiries in your credit file only on genuine reasons if they are holding your debt. Ask them to validate the debt where they need to give you the complete details of the account. If they are unable to validate the debt, they should stop contacting you and remove any negative remark, if put in your credit file. Do all your correspondence certified with return receipt requested. This will help you to track down all the correspondence made and you will have legal proof of it. Allied Interstate might have run through your credit report to see if you have any account due with your creditors. The credit card providers or the banks often view the credit file to see if a pre-approved credit card, or a loan, or mortgage can be offered. In the same way, Allied did similar activity to seek collection towards your account. It is serious issue if an agency reports negative information in your credit file without legitimate cause. If allied has put inquiry in your credit file and they are unable to validate the debt, you will lose some scores for it. Take active steps if you don't hear from them and get all the negative information removed from your credit file. |

Do I have to pick up the phone the next time they call, or can I draw first blood? And by that, I mean send them a letter telling them that I know they rooted thru my husband's credit report and that they've been trying to contact us. That way, I could then ask them for validation of the alleged debt.

In your debt validation request, you mention that until the debt is validated, you refuse to be contacted at your place of work and home and all correspondence should be done through mail only.
Once they received your letter, they are required to stop calling you otherwise it will result violation of the fdcpa law. You will be in charge of taking legal actions against them. Your main intention to contact the debt collector is for two reasons:

last night my boyfriend received a call from this agency telling him he owed $2000 for a bill in 1990 but they would settle today for $800 he told them he was in Mexico at that time and then they put on a spanish speaking rep who told him he was hard to track down and he stated "what are you talking about I file my income tax every year" When I got on the phone I asked them what this was regarding and immediately he asked if the social security number was bought because obviously my boyfriend is mexican

The company has to send you a debt validation letter before making any collection efforts. Then, you can dispute it as the SOL period has well expired. |

I think you should contact the credit bureau and get the address of allied interstate in Washington. They have a huge database of all the creditors and the collection agencies operating in US. Hope this you a little. Regards Roxette __________________

You should have a written agreement with the company that they will update your account with the bureaus after the payments are complete. Besides, any agency is not allowed to keep negative information in the credit file without legitimate reasons. If it's done, you will show this written agreement as proof and force them to update your file. Keep everything documented and send your letter certified with return receipt requested. |
