Hello,

I need to know if anyone has heard of A S & Associates. I received a call from this lady at 866-331-6161 claiming to be an investigator with a particular county and I needed to call back concerning a legal matter. I called her back to find out she was calling me concerning the payday loan I defaulted on. I went through a horrible divorce and and I'm a single mom trying to get back on my feet. I explained to her my situation and am willing to set up some kind of payment arrangement. I was threatened if I couldn't come up with at least 50% of the money owed I would most likely get arrested or possibly probation. If anyone knows anything about them please let me know. Thanks!

Yup they are a nasty CA very similar to Elis Crosby, meybe even former employees.

They called my old Mom and my cousin and scared them to shit that I was in big criminal trouble.

My dear, there is no such thing as debtor's prison. We do not live in the 18th century. Postdated checks used to get loans are not bad checks either. A bad check is a check that violates COD, Cash on Delivery. It's not like you are receiving a merchandise and you fail to pay for it on delivery.

So don't you worry at all and read this forum and educate and arm yourself for dealing with these predators.

Hi Klp

Welcome to the forums.

As said by Kam, there is nothing to worry as long as you are willing to follow the rules put in the fdcpa. Before you send any money to the agency, the debt collector must send you in writing about the details of the accounts through complete debt validation. You can refuse to make payment until your debt is accurately presented.

Be careful while dealing with this collection agency. Do not make any payment agreement and update your contact information until they have sent you the correct details. They need to first prove that they are contacting the right person with the correct SSN# and with the right account.

Thank you so much for the reply. I do feel better. They had me in tears last night over this. I will follow through with fdcpa rules and continue the process. Again, thanks so much for the help!

Don't worry. Just read the fdcpa laws in the FTC website. Trust me, you will feel better. And perhaps, you will realize that there was nothing to be in tears last night. Now you will be able to handle them strongly.

klp, the fdcps laws are not for YOU to follow, they are for the collection agency to follow. while they shouldn't be threatening you with jail, it is in your best interest to cooperate with the agency. if they are demanding 50% then you should do everything you can to come up with the funds. if you fall short, you should contact them asap and let them know how much you are willing to put down as a good faith gesture.

i was in tears also from this agency a s & associates. this very nasty woman has been calling and threating me about this debt. she said that if i didnt have the payment in her office, my name would be put out there in the system and other things were going to happen to me. advice please, what do i do

Maria, don't feel scared. The collectors do that kind of illegal threats so that people like you get scared and send them money without verifying it and without any documentation. Did you ask for a debt validation? Stick to your ground and say that you won't send any money until they have validated the debt and you have reviewed it. You will feel better after reading the FDCPA laws. Use this as your legal weapon when you get the collector's call next time. Trust me, nothing is going to happen as long as you are aware of your legal rights and the collector is not acting according to the federal laws.

I am dealing with them as well........A Greg Patton has been calling me....What if you get validation in writing but you dont agree with it? What can I do?

I received a call from Greg Patton today as he is threating me with 2 counts of criminal acts. One for a bad check and one for fraud. I asked him to send me somethingin writing he told me that he did not care if I paid 1 cent on the account he was going to have me served and prosecuted tomorrow. I am a little scared but not completly because I know that they are just trying to scare me. He then called my work and talked to my supervisor and told her that he wanted to have me served with papers. She however told him that it was a personal matter and that he would have to discuss it with me only.Any suggestions would be greatly appreciated.

AHHHHHHHHHH the famous Greg Patton..........he tried the same thing on me. Told me the exact same thing he told you........although he did finally fax me over an invalid account balance on a pdl I got from National Money Store. Good for your supervisor telling him that.......I sent them a Ceast and Desist letter to them and I also filed complaints with the TX AG.

What happened after you filed complaints and sent them a cease and desist letter? Anything? I had a Henry Jay contact me from there, and sent them c&d and dv letter certified back in April and have received any calls or correspondence since then. I filed with the BBB, DFI, and FTC, and nothing back from those agencies either.

i did contact my lawyer who told me that if he calls again he is to only contact him. he is to have no further contact with me. I did report them to the ftc.

I recieved a call from a person at A & S Associates while at work today. Based on the comments by those in this forum, I faxed them a request for validation. Within 10 minutes I had a call from a different person there asking me to call back at my "earliest" convience. I then sent them a C&D for contacting me at my place of business by phone, fax, mail or in person.

My next step is to let them know that I will only deal with the original creditor.

where can I find a copy of a cease and desist letter for these idiots.
