hey call constantly and do not leave voicemails. They call two times per day and do not attempt to contact in any other format.
Collectors and Bill Collection Attorneys not following the rules Capital One Accounts and others!
Remember if they cannot reach you they cannot serve you and attempt a judgement or lien! They play the old creditor bill collector game of calling and if you are not the person they hang up. If they reach voicemail they do not leave messages of any kind. It would be nice to know what account, and basics that do not violate Federal Fair Debt Collection. I will not respond until they use one of the many other formats to contact me. If you have ever had your identity stolen you would understand why! Bill Collector: I am calling for John Huntsman, if you say yes this is and you happen to not be the same John Huntsman your hell just began. Attorneys always negotiate the deals on settling debts and there are many pseudo attorneys and those who just by debts from other companies. They buy them for pennies on the dollar and then go for the original amount and much more! Third District Court in Utah even has a law firm which requested a full one page list (post judgement) requesting everything about property (allowed) as well as the many other phone numbers you can be reached at, your spouse information, other work places,other creditor accounts, other judgements,previous bankruptcies,do you have any other delinquent accounts etc! Legitimate firms shouldn't have a problem giving you their company name and mailing address so you can send them a letter telling them to quit calling you because they have the WRONG phone number. I have been getting phone calls for some person I don't even know from them for a month now. I have had this phone number for well over a year. I answered the phone call once, and the automated system told me to press 2 if I wasn't the person they named. I did so, and their agent came on and I told him "wrong number". He said they would take my number "out of the system and notate the file". Well weeks later, they are still calling everyday, even weekends sometimes, at varying hours. Yesterday I answered again, to hear the same automated message, except no option 2 this time. This time it just said to hang up if I wasn't the person they were asking for. Very sneaky. They called again today, but give you no option to actually talk to someone if you are not the person. The just tell you to "hang up if you are not... (robot voicy)... whatshername." Very annoyed, I looked up on-line to see if I have any recourse if I am getting calls for someone else and want them to stop. I found that all I could do legally was write them a letter telling them to stop, and then if they still call I can have recourse against them. So, I called their number as it showed up on caller ID 8888320243, in order to get their company name and mailing address so that I can send them such a letter. When the receptionist answered I told her that I am receiving repeated calls for someone else, that I already told them once that this was the case, and that I wanted their name and address so I can send them a letter requesting they stop, so if they don't I can take action. She took my phone number, and then informed me that they had no notation on the file, have only been calling my number for 2-3 weeks (its been longer), and have no option two so I must be meaning to get a hold of some other company. When I informed her I called the exact number off of caller ID, so they had to be the right company, and asked again for their company name and mailing address, she told me that a notation had been made and it takes 24 hours to process. I told her that it was all well and good a notation had been made, but that was what the other guy said, but the phone calls hadn't stopped, and therefore I wanted her company's name and mailing address. She just repeated that a notation had been made and it would take 24 hours to process. I repeated that I still wanted their name and address, and she got incredibly snotty and just said "obviously you can't listen", and then hung up. Does this sound a like a company with good business practice to you? I understand that there are flakes in the world who don't pay, and people do have the right to try to collect what is owed, but do innocent people have to suffer for it? I have no bill I have not paid, do I get punished because someone else hasn't paid theirs? Is that any reason to treat me poorly, and not give me the information I would need to make sure you as a company are doing your job within the rules of the game? Why should I have to take time to write a letter at all? Has your company become so jaded working with the not-so-great in society, that now you just treat everyone poorly? What a sad state of affairs in that case. Just doesn't seem like a good business anyway you look at it.

If they are threatening you, get all info. you can from them, turn it in to the District Attorneys office, file a complaint. They will contact Bennett personally, possible fines for that company. Contact courthouse and report them.

I have also received inumerable calls from this agency. I asked for a copy of this debt (bill, judgement, court order, restitution, etc) be mailed to me and told 'we don't have to'.
I have suspicions that 'they' scour official records and glean names and circumstances to claim there is a debt owed when it seems there is not. Which would explain why Bennett-Deloney is so uncooperative about mailing written copies. Glad I came across this site - never made the connection that if B-D are not willing to validate their claim to me, I can request they stop calling. |

Per "comment 02-17-10. If they are contacting you for a debt & you request info over the phone verbally they do not have to provide it to you. The FDCPA (law) you have 30 days to request that info in writing. They have to have your request w/you signature. If they are representing them selves as a law firm not collection agency they are given files by their retained by.

They are a bunch of vultures! I settled a debt with them and they took over $2500 out of my bank account. Do not trust their "verbal agreements" and do not give them your bank info. I learned the hard way and now I'm trying to figure out to take legal action against "Bennett and Deloney."
