Anyone heard of Bergen-Boesch? They appear to be a collection agency for National Money Store, who has threatened to arrest me if I don't pay them. I have been reading the forums, and is it true that the company needs to send me something in writing before anything like this can actually happen. I looked them in on bbb.org and there are no complaints and their address is 17117 Westheimer Suite 32, Houston TX 77082-866-777-0977

Hi! It is true that a collection agency is bounded by the FDCPA laws. It is your consumer right to ask the company for a debt validation of your accounts. You need to get the accurate account details for which they are calling you. Read this page for more details on the debt validation clause:

After the company has proven its legitimate purpose, then only make a payment agreement with them. It is better to send your letters through certified mail with return receipt requested. Keep copies documented in a file for records. After your debt validation letter is received by the collector, they must not call you before you have received the details. If they fail to validate the debt within the 30 days period, you can explain their failure to the bureau. They will conduct an investigation with the company. If your credit report has been hit by the company, the remark will be removed and you will maintain your credit worthiness.

I've never heard of that agency, and the name sounds similar to that of a Nazi concentration camp from the World War 2 years. The collectors are certainly behaving like Nazis to boot!
My friend, I used to collect payday loans, I've seen some that have been in default for over a year and I have talked to the perspective debtors at their home. Nobody goes to jail over a few hundred bucks, that's ludicrous. Don't listen to them, you don't even have to talk to them, and if you go directly to the place you borrowed the money from, they will accept your payment. Don't send anything to the collection agencies who violate your civil rights. How can you possibly trust them? Keep your bank account and credit card numbers to yourself. Do not accept their phone calls. When third party collection agencies do the dirty work for the payday loan company, the loan compnay gives the collector a percentage of the collected debt as gratuity. That's why third party collectors can be such jerks. They are over-eager to either buy ego-boosting toys. Hypocrites and charlatans.

Keep a check on your credit report also. It might happen that this company will try to hit your file with a negative remark. If done, your scores will get lowered. You will have to begin the process of disputing with them. If you inform the credit bureaus in advance, they may not allow the company to hit your file without legal reasons. Being pro-active is the best way to handle such situations.

Write a letter to the credit bureau at their mailing address and explain the problems that you fear having with the collection agency. Send your letter through certified mail with return receipt requested and keep copies documented in a file for records. Once the bureau receives your explanation, they will get aware of the situation and you will have made your point stronger if the CA tries to hit on your file negatively.

CollectCorp Fraudsters, I began my collections experience at CCA where they are FDCPA sticklers, and I believed for certain that all collection agencies were the same because it's federal law for crying out loud. I'm considerably bothered by the fact that very few collectors obey the FDCPA. I'll bet they can't even spell FDCPA.

Your local police have better things to do than be the "muscle" for some shady collection agency. Law enforcement NEVER wants to get involved in civil issues!
The only thing the police might do deliver a summons, provided the collection agency follows the correct proceedures.

Yeah really. With all the murderers, rapists, arsonists, mafia, bank robbers, and gangbangers out there that they have to arrest, I highly doubt payday borrower have made it onto the priority list.
When collectors say that they will have the sheriff issue a warrant, that's farcical. The guy will say he has bigger fish to fry, and he does!
