Can a pay day company (Cash Inc. - Toronto) call my Human Resources Administrator and tell them that they are going to start a garnishment process against me? My administrator forwarded the message to me. They even asked her to call back and let them know what my company's process is for this - basically what the "protocol" is. Can they call my work place?

Unfortunately they do it. These snakes will do anything to embarrass us. They can't garnish you without a court order. I know what you're up against here, I have one that liked to call, but I sent a cease and desist letter and that seemed to stop the calls. You might want to contact the payday loan people and try to set up some arangements, obviously they haven't taken any action to garnish you yet. Hopefully you can make some satisfactory arrangements that will shut them up and let you have some peace. Good luck!

Also check your contract and make sure you did not aign /agree to a voluntary wage assignment.. if you did, fax them and mail them (CCR) a letter revoking the assignment today.

Finsfan is correct. They cannot garnish without a court order. I had a couple of them call my HR department but only to verify employment. They are only trying to intimidate you, I had one guy call me at work and then want me to transfer him to HR, NOT! He called them back to verify employment and then asked them to let me know he called, what a jerk. Good luck and be strong!

Thanks everyone! They initally did call to verify employment and then called back and left a message with HR. It was embarassing. I am contacting a credit counselling company tomorrow. Would someone happen to know what documents they will need from me so that I can be prepared. I have moved recently and lost some contracts so all I have is address information, telephone information and amounts - would that suffice. Hopefully this will be an end to sleepless nights.
