Debiting the accounts without authorization is definitely against the law. But companies doing illegal practices don't really care for the things termed as 'legal'.
Though it might be difficult to recover the money that is somehow lost to such illegal companies, but chances to stop such companies from existing is there if appropriate measures are taken rapidly.
This all happened at the wrong time when a proper research about a company was not done properly. But the consequences faced have taught a good lesson for the future.

Thanks Roxette, I thought it was. But how would I go about seeking restitution? Should I contact an attorney? I mean, Cash Today, LTD and other payday lenders that I revoked ACH debits on have costs me over $1000 total in overdraft and return item fees. Before I revoked the debits, I contacted all the lenders and told them I was experiencing financial difficulty and that my account was overdrawn. I asked if I could make other payment arrangements, none of them returned my calls and still took out payments, knowing my account was overdrawn.

Do you have any proof of this communication made? If it was done in writing, your legal approach towards this case will be much stronger.
Basically, the lawyer will also be looking for some strong evidences to make your case stronger.

I have ben fighting with this company for months to cease and desist taking money out of my account for what they claim is to extend a loand that was supposed to be paid off months ago. They are located in England according to the drones that keep repeating the same thing over and over. I cannot get an address for them but am trying to track thm down as well.

I applied for a loan with this company this morning and got the call to confirm within one hour. I accepted the terms and then found this site with all your problems. I wish to god I had looked here first!!!! I have since called them back and cancelled the loan. I am literally sweatin bullets hoping they have actually cancelled the loan. I am having a small financial issue, but sure as heck dont want it to get bigger. I would rather deal with a couple returned checks then go through the hell you all are going through. Good luck.

I to have a loan with them. They have only called my job one day but boy oh boy was this guy persistant. I just kept on lying and saying I was not in. The guy wanted to speak with my supervisor and I refussed to let him. I am the receptionist so I can screen the calls well. Plus the idiot is asking for a wrong name when he is asking for my supervisor. My only bitch is they do not quit in a 20 min time frame he called like 30 times at least. I refuse to pay these people now. They will never see another dime from me. They received all of their money and then some about 5 times!!!! I was scared someone would ask why the phone is ringing so much. They did not thank goodness. Something should be done about these people they need to be reported!

I wish I had done the same as you sweatinbullets. I will never do it again. Trust me some bounced check fees are nothing compared to $59 per week until you decide to pay the loan off. It is a scam but looks very appealing. Especialy for those who have horrible credit and cannot be approved for a loan. That is how I found these people. I put bad credit personal loan in the search engine and here I sit owing boarder line psyco's money!!! I wish I never took the loan out!!!

Welcome to the forums. I also feel that you should send a letter through certified mail with return receipt requested. You will be more accurate in your intentions about canceling the loan and you will also have a record of your efforts made.
Before the company makes a move against you, you have a proof of your final move already made.

I don't know whether I'm glad or not that I found this thread...I have a loan through Cash Today Ltd, and I have had growing debt and trouble paying it off. I had to change my bank because they keep trying to take funds out of my account and putting me further in the hole. I actually had a loan through them before and paid it off, but then they called a month or so after it was paid and tried to confuse me and get me to reloan. The guy said he was calling to confirm my loan for $200. I was like, huh? I don't want another loan! So be prepared...if you pay them, they still may not leave you alone.
So now I've got the loan out AGAIN, which I am unable to pay (and really unwilling to at this point, because they won't take a money order and I don't want them to have my new bank or debit card info) and I'm filing bankruptcy this week. Has anyone actually FILED bankruptcy yet and still had them harrass you? I'm wondering if I have my case info if they will stop calling. And plus, do they have to abide by our debt and collection practices since they are in the UK? Has anyone found out for sure?
Good luck to you all...these people are crazy, and I was worried about them from the beginning. It's a shame what those of us with poor credit must do when we have medical expenses, etc. It's a terrible lesson to have to learn.

So today they called my work again. It was a lady this time every other call has been from a man. So I knew she would not recognize my voice. I told her she did not work here anymore. Then asked to speak to the Human Resource person. I told her we did not have one it was a small company. I was her supervisor. So she verified my name and time and date with me and said the calls will stop. We will see I will keep you updated!!! So hopfuly it works. I will just continue to tell them that I no longer work here!

Welcome to the forums.
After paying off the first loan, have you taken the receipts of your payments made? Has your account been updated with the credit bureaus? These are some of the important things to prove that your loan account has been paid off and you do not owe the particular debt.
Regarding the new loan amount that you have taken, after filing bankruptcy, it is supposed to get discharged off. Once you have filed bankruptcy, any company irrespective of the area of its operation cannot force you to pay the said debt. The simple reason being that the debt has already been discharged when bankruptcy has been filed.
Consult your bankruptcy attorney if further harassments continue and keep all the necessary paper intact.

Well we have all read how psyco these people are. About an hour ago I told them I no longer worked at my job. I was obviously lying! Anyway they have not called back at all. Which is not their normal proceedure. The last time someone called they called like 30 times. I know it will not erase the debt but it hopfuly will get them to stop calling your job which I feel is the worst part of the whole process!!!

Daniella, why not make this whole approach completely legal as per the fdcpa law. Send a cease and desist letter through certified mail with return receipt requested. This receipt will prove that you have made the legal efforts on the date specified on it. Once they receive your letter, they are required to stop all the collection calls.
Also, if it is even harassing, you can inform them that the call is on record and that you wish to present it to your lawyer. He will be taking care of it and hopefully, you will be able to see some positive results out of it. I am sure that success will be yours.

This message is for FatFreddy. I have paid every week on time. I have had no choice they automaticaly take money from my account. They still call and harrass me. The one guy that called last week said "give me my money" and called 30 more times to harrass me. But funny every week they get their retarded $59!!!! These people are rude and inconsiderate.

As I keep reading I keep coming up with better ideas on how to beat these people. It seems to me that the biggest problem outside of harrassment is not being able to afford the constant overdraft fees and weekly fee they charge. I think you should suck it up for one week and call Cash today tell them you would like to pay the loan in full and deal with your bank. Get it all done in one shot. Basically it will save you money in the end and it will get Cash today off your back. Pay your bank back the one time fee instead of your account overdrawing every week and paying the bank a fee every week for being overdrawn. Does this make any sense. Suffer one week but it be over by the next. I think this is what I might do. Since they are just going to overdraw my account every week. I stopped my direct deposit because of it. So now they are just withdrawing from a negative account.
