    This letter is regarding account # 000-000-000-000, which you claim I owe. This is not a refusal to pay, but a notice that your claim is disputed.

    I am requesting validation, made pursuant to the Fair Debt Collection Practices Act. Please note that I am requesting "validation"; that is competent evidence bearing my signature, showing that I have some contractual obligation to pay you.

    Please also be aware that any negative mark found on my credit reports from your company or any company that you represent for a debt that I don't owe is a violation of the Fair Credit Reporting Act; therefore if you cannot validate the debt, you must request that all credit reporting agencies delete the entry.

    Pending the outcome of my investigation of any evidence that you submit, you are instructed to take no action that could be detrimental to any of my credit reports.

Well, my payroll department did take the money out of my pay and now I am screwed. I am not however taking another payday loan out. I can't do anything except deal with it. I did notify my payroll department to never take it out unless it's a court order again.

Sorry to hear that. Do they know that wage assignments were done way with back in 1985. Also, I have found out, that even if for whatever reason you do a wage assignment...it has to be signed in person. Electronic signatures CANNOT be accepted, nor can your social security number used as a stamp (signature).

I would discuss this with your payroll. Has the payment they sent already gone through??? Or is it waiting to be sent...sitting somewhere???

Cash Today garnished your wages?
I wish they'd garnish mine..they called me 25 times last night at work and called my cell phone just before 10pm last night...I told the guy I was filing bankruptcy and that I would give him my attorney's number, and he said I don't want to talk to him..I want to talk to you...You're working why won't you pay? I said your payment arrangements are ridiculous...I've been give 3 different settlement offers, and you are refusing to provide me with proof of my debt. He called and called and called and called and called...and I told him, everytime you call, I'm going to hang right back up on you...It's irritating and frustrating..and if I could find the right lawyer, I WOULD sue them!

I thought you had to have a judegment against you and a court order to have your wages garnished for unsecured debts. Getoffmycloud, you should contact an attorney and find out for sure. Tell them your story because Cash Today may have illegally seized your wages. Besides, how do you know if the amount they took was what was legally owed to them?

wage assignments are a little piece of paper you sign usually when getting a loan.

Garnishments are court ordered. Assignments are not. So your payroll department...if they're smart and know about the laws regarding them, can simply deny it.

I keep reading that wage assignments have to be signed in person though. So you might have a case if you're willing to pursue it.

I have notified my payroll department to no longer honor these type of deductions. I am not sure if it is worth fighting for now. I just want them to stop harrassing me. At least this way, they can't lie and say I haven't paid them this week. I hope everyone else have a good weekend.

Did you find out if the payment had been sent out already? Your payroll department should not have honored that deduction. I would also find out what was sent to them. Your employer may have this confused with a court ordered garnishment and think that they would be liable. I work for a payroll company, so thats how I am familiar with some of the in's and out's of this type of stuff.

I just got paid today and my payroll department is off until Monday. I have the amount that was sent to them. Thank you! What I can try to do is see if someone in human resources and check it out but knowing my job (been with them for 10 years!) I doubt it. There is one person who does it and she is off until Monday.

The thing is that I paid most of my bills except my phone bill and now that has been disconnected. It totally sucks! What are you going to do though? I sent out an cease phone contact letter a week ago. I haven't received the confirmation back yet. The postal website isn't the best as far as accurate info either. I found this out on a package I was sending. I just hope they don't bother me at work since I work in an ER. They had all the lines of the ER tied up so then it transfers over to the main switchboard. I had to call the local police department and he had to argue with them. He told me he knew he was harrassing me and didn't care. I was just asking him to call me at home or for me to get a number to call him back the next day. He would not do either. The one thing is that I am working shifts so that by the end of the month I will NEVER have to go through this again.

I wish I could do the samething. Unfortunately I dont hazve anyone to watch the kids. At the same time I cant afford for the phone to get cutoff because i have to get a hold of my oldest in the afternoon.

GetOffMyCloud, you should have never had to go through this in the first place. I cant beleive they would jeopardize other peoples lives by repeadidly calling the ER that you work at. If at all possible, next time they call and you can take their call, tell them that that they are being recorded for legal purposes and that they are to immediately stop calling your place of business. Dont engage in any futher conversation, just hang up. If worse comes to worse and they wont stop on their own, then call an attorney! Explain what is going on. Filing a lawsuit against them will STOP them from harassing you, which is the most important thing.
