I sent out the cease letter over a week ago and I haven't had any messages left. I did tell them to not call me at work but only at home. They wanted their money that minute. I am sorry but I didn't feel comfortable giving them my debit/credit card info over the phone. I told them I worked in an ER and they didn't care. I hungup the phone, they called back. It was so bad EVERYONE in this department was answering the phone and hanging up. It was close to a hundred calls logged in a half hour time. It was embarrassing. I was in tears. I have an excellent work record. I told them they were harrassing me and they laughed and said "I know". They have told other people my situation. I had to call the local police department which they sent over an officer who had to ARGUE with them to stop. The nursing supervisor for the whole hospital also notified the local phone company. My payroll department said to me today that what they did was legal by asking to get the deduction taken out of my pay even though I wasn't notified of the amount. It wasn't a court order either. The thing is what type of lawyer do I look for to represent me?

I haven't been able to see the document yet. They were not in the office on Friday and it is now the weekend. I have emailed her and asked for a copy. I will let you know as soon as I receive it.

I dont recall that you mentioned it before, but what state are you in. The reason I ask is because state laws override federal.

Although the your company states it was not an actual wage garnishment, I would get with a garnishment lawyer. I am sure that they can do a free consultation so that you can explain your case. It wouldn't hurt to try.

Wage garnishments and wage assignments are 2 totally different things. From what I have gathered, involuntary wage assignments were done away with in 1985. This means you can take back or void your wage assignment.

Not only that, the wage assignment has to be signed in person. Electronic signatures that are usually "stamped" with your social security number and printed (typed) name cannot be used.

I agree with Rhonda...you might want to seek more advice, perhaps from an attorney if you're wishing to pursue this matter.

oh and another comment regarding the wage garnishment. I read on another board that through Sonic Payday--- check your original loan documents, you sign a wage assignment form, and from my understanding it is valid and legal. Its the only way they can garnish your wages short of getting a court order...

Actually I just read the loan agreement with sonic payday and it does not state anywhere about a wage assignment. There are some companies that have the clause in there but it is not in my documents with sonic. As mikey said, with a wage assignment, you can revoke it unlike a garnishment where it has to go through the courts.

I just emailed the State of Nevada with my story and told them that I have the documentation proving harrassment from this company. I have also paid $554 for a $200 loan. This needs to stop and I don't want anyone to go through what I did. I do have the police report and a letter from the hospital superviors, phone company, and other employees of what happened that day. I have received my receipt back that they have signed for my cease letter. I am getting a copy of the wage garishment to have a lawyer take a look at it. I haven't heard from them since they received my cease letter. I will let you guys know what happens. I have paid my debt and they need to be stopped.

GetOffMyCloud

Very smart move. We all should be aware of our consumer rights and take preventive steps so that such illegal activities can be averted.
