Collectcorp collection agency - Are they known for FDCPA violation?
Collectcorp Corporation is a collection agency located in Phoenix, Arizona. Many consumers complain that they faced problems while dealing with this collection agency. These problems are varied in nature and some of them, as shared by the guests and members of the DebtCC community, are discussed below.
Collectcorp complaints - Do they speak good of the company?
Even though Collectcorp has a good BBB rating, there are consumer grievances against them. The complaints against the CA does not quite speak good of the company. A few of these complaints are as follows:
- Collecting money even after debt is paid off: A consumer alleges that the collection agency came after him even though he had paid off the debt. He says he repaid the debt in full to avoid any negative mark on credit report. Later on, the CA demanded another $6 saying he still owed the interest accrued before the payment was made. Know more.
- Not complying with agreement: A customer says he settled a debt with Collectcorp. As per the agreement, they were supposed to withdraw money from his account on a particular date. But they withdrew money 1 week earlier than they were supposed to. This caused the customer to pay an extra $300 in bank fees. Get more on this.
Are there complaints of FDCPA violation by Collectcorp?
Consumers have accused the collection agency of violating the FDCPA (Fair Debt Collection Practices Act) on quite a few occasions. Some of the instances where the CA violated the debt collection laws are as follows:
- Making calls at workplace: A consumer complains that the collection agency called him at his place of work repeatedly even though he had asked them to not do so. They refused to stop calling him at work until he paid them off in full. They even threatened to garnish his wages if he failed to make payments. Find more.
- Making calls to friends and family: Another person says that Collectcorp makes annoying calls to his ex, who got divorced years ago. He says that his ex is not responsible for the debt and hence the CA should stop calling her. Get more on this.
The FDCPA lays down the rules which the collection agencies are bound to follow. As per the laws, no collection agency is allowed to call you at your place of work if your office policy prohibits it. The CAs are also not permitted to make calls to your friends, family and neighbors unless they fail to get in touch with you. They cannot also disclose your debt-related information to anyone apart from you.
What do you do if the CA tries to collect an old debt from you?
The CA may come after you to collect an old debt which has either been settled long time back or crossed the Statute of Limitations (SOL). This type of debts are also known as "zombie debts", which may come to haunt you when a collection agency attempts to collect it from you. The CAs often resort to illegal and unethical practices, like fraudulently changing the age of the debt, etc., to collect these zombie debts from debtors.
In case Collectcorp or any other collection agency contacts you to recover an old account which you do not remember or which you have already paid off, beware! Chances are that the CA is trying to collect a zombie debt from you. Thus, when you pay off a debt, you should save all the documents, copies of checks and bank statements, etc. to prove that the debt has been repaid. This will protect you from zombie debt collections.
You should also check if the debt is passed the Statute of Limitations. If it has crossed the SOL, you do not have to worry about repaying the debt. You can simply send a letter through certified mail with return receipt requested asking the CA to stop all collection attempts. However, you should remember that making payments to the CA to remove the item from credit report can renew the SOL. This is why, you should not make payments to the CA until they validate the debt.
