hi all, I received a letter in the mail yesterday stating that I owed a debt that fell off all my credit reports. I haven't paid on it in over 7 years. I live in connecticut and after 7 years credit card debt falls off. The item was taken off in feburary of 2009 and now I have a judgement against me to pay the amount owed. WHAT??? I did dispute this item to make sure it was going to be removed from my credit report but only with the bureus and it was removed. So now this company I owed sold it/ transferred it to a law firm AFTER it was removed. Do I have a leg to stand on? Are they allowed to put something back on credit report to get their money back?

If it's past the SOL, it's past the SOL, and they are - well, SOL.
Call your county court and find out about the case. Let them know you had no idea about it and you want to file a Motion to Dismiss due to Improper Service. Let them sue you again, properly this time, bring in your evidence of SOL to the court, and file a Motion to Dismiss with Prejudice - which means they will never be able to come after you for it again. Do Not send them anything they are possible one of those companies that try and get monies from closed or bankrupt accounts. They sent me a notice that I owed an amount and it was from a bankruptsy from several years back. I was lucky enough to have my credit report recently and found that this account had been settled years earlier. I have sent them an letter telling them that this is the case and sent the letter to the BBB.

I recieved a letter today about a creditcard account that I never had, I went to court 4years ago and proved my case in front of a judge, someone had opened it using my info. The judge dismissed it. these people apparently do not keep up with anything they seem to be nunfit to collect even accurate information.

I received a letter from First National saying "your delinquent account has been assigned to us by the above mentioned client. They listed Valorem LLC and an old credit card company I once dealt with. The last payment to that company was June 05, and by January 06, the company had charged off the debt and sold it to another lender. I responded to First National that 1) the CA SOL had run on on any debt previously owed to that credit card, and 2) they misrepresented themselves to me because that particular credit card company no longer exists, and I have no knowledge of Valorem LLC and have never dealt with them and do not owe them anything. I cited FDCPA 812 as well. I did not mention this, but I am unemployed and own absolutely nothing, so I don't think they would get very far trying to take me to court, even if it's just so I can present the CA SOL as my defense. Was this the right way to handle this?
