Is it not 3rd party disclosure if they leave
"This is an attempt to collect a debt" on a voicemail, voicemail is a 3rd party no matter what...correct???

After seeing some of the cocky responses from those claiming to be First National employees I'd just like to inform everyone here that this is the business I recently posted about - they sent a collection letter stating that a judgement had been awarded against me & I should take advantage of their 60% settlement offer.

Well...I did my homework & there is no judgment! After demanding proof of the judgment some self assured lady at Firt National told me that they closed my case at their end & sent it right back where it came from.

To me, their reaction & quick exit strategy is a strong indication that this was indeed an illegal scare tactic - and they just got caught. After all, if there was a judgement why wouldn't they stick their ground for payment?

I've forwarded my information to a Chicago based consumer rights attorney that specialized in the fdcpa and class action suits against unreputable companies like First National Collections Bureau.

Good question! I also received a notice a few days ago stating that I owe an utility bill of 10 years ago. I have always paid all my bills and so I am going to investigate this one! I suspect they are a scam!!!

The above-mentioned experiences just go to show it always pays to do your homework. Research, investigate, and document any calls, letters, or other communications you receive from a company claiming to be collecting on a debt you believe is not yours, was paid in the past, or doesn't even exist.

And DEMAND VALIDATION IN WRITING. Many of the junk debt buyers are attempting to collect on closed files that were paid in full, by telling you there was still a balance due when you thought you paid it off. Unfortunately, many people fall for this trick and pay (often including whatever fees the CA has added on to the balance), because they don't have any record that the debt was paid, or they can't remember. This is especially true when the CA gets ahold of an elderly consumer - which is disgraceful on the CA's part.

Bottom line - if you don't think you owe the debt, question it. Demand validation. And if at all possible, keep records of everything you've paid to any of your creditors from here on out, from your utility bills to your credit card bills to the local car repairman. Having a full filing cabinet is a small price to pay for having the documentation to prove payment of a debt if a shady CA comes calling.

Sometimes they also (knowingly or mistakenly) sell a portfolio with paid accounts.

I have received two phone calls for my wife from FNCB. THey just say that I need to contact them immediately regarding a credit matter.

I'm not inclined to do anything at all since there is nothing yet received in writing. Am I okay to do nothing since they've sent me nothing in writing yet?

They are bound by the fdcpa to send you the standard dunning letter within 5 days of when they first speak to the person in question.

These morons keep harassing me for a debt by some idiot I don't know and never met. Calls come all hours of the day, all days of the week, all weeks of the year. It is infuriating. When I ask to have the number deleted from their dbase the calls stop for a few days, maybe weeks, and then the harassment starts anew.

I've reported them to the BBB of Nevada, but if this does not work I am resolved to call their CEO and VP every time they call me back. Their numbers are listed on the BBB site. Join me.

to let any one out there know is all they want is money and most of the acct they have are way over sol there is no way they can do anything to you if you dont oay your bill there clients will just recall the acct and see if another agenciey can get you to pay so if you dont want to pay you dont have but they will find so just be prepared for them to keep calling u every day by law they can call you once a day every day but that is it if it is more then that then you can report harassment on them

Daydreamer, what you choose to do is up to you; however, no one on this forum advocates not paying your bills. If you have the means to repay, and are able, then you should do so. Please don't tell people not to pay their bills as this is just not constructive advice.

This company calls me 10 x a day, as early as 7 am and as late at 9 pm and even on saturdays and sundays. I pick up and it is usually some recording. Does this company also have the number 800-824-6191 and is the Reno, NV address the same for the above number. I do not know why they are calling and I want to send a DV letter to stop their harrassment.

You can stop the calls by sending them a written request to only contact you via USPS. Any calls before 8AM or after 9PM are prohibited by the Fair Debt Collection Practices Act and can be pursued via civil suit for $1,000 per call in violation, this also applies to calls after a notice has been received such as I suggested.

It would be best to send the request certified mail, return receipt requested.

I just recieved a letter from First National Collection Bureau, Inc. And it just doesn't make any sense to me. The name and address is correct. I did owe this credit card before but, it was paid in full more than 4 years ago and was never on my credit report. I was surprised to see this letter. I called FNC and was getting the run arounds. I was told that the information they have of me was in bits and pieces. And said that the account was sold to them from another debt collector agency. I was heated! They threaten me by saying if I don't pay them, they will put this debt back into my credit report. Can they do that? What should I do? HELP?!

If it has run the 7 year reporting period already they can't reinsert it, if they do then you could sue them for $1,000 per entry, I would suggest sending them a debt validation letter (you can find a good template via my signature) send it certified mail, return receipt requested.

FNCB is a SCAM. They "buy" old debts which are well over SOL, and they randomly contact people for payment (even though they know it's not that person's debt). And here's the thing.....first they scare you, then they act like they are giving in and offer to settle for 50% of the debt.

Don't pay them if you really know for sure you don't owe anything.

By the way, I notice how everyone is talking about complaints to Nevada Attorney General. that's fine. But this company is incorporated and licensed by FLORIDA (check on corporationwiki.com because this forum won't let me post a link). So FILE A COMPLAINT with FLORIDA ATTORNEY GENERAL's office or FLORIDA Department which licensed these scammers.
