They call me all the time without leaving a message. I happen to be here today and received the call they said they were a debt collector of 279.00 I ask did you send me any letter they said three week ago. I looked in my may and march file and told them I hadn't received anything. While I was looking she ask to vierify my last four digits of my social and I gave it to her. By that time I told her here you are on the computer because I saw this, she hung up the phone in my face but she has the last four digits of my social so what can I do?

I would suggest sending them a debt validation letter. You can find a good template via my signature link, be sure to send the enclosure with it certified mail, return receipt requested. Stand by and I will find a mailing address for you.

I got this letter in the mail today from fncb. This has to do with a credit card that my husband & I had over 10 years ago. Maybe more. I left him in Va. in 1999.Our devoice was final in 2002. My ex is the one that owes this bill. Not me! The card was in my name, but he stole it from me & used it without my knowledge. I am wheelchair bound & live on my monthly SS check. I don't have $539.53 to send these people two months in a row. Do I need to be concerned about this?

If he was never an authorized user for the account it could be construed as theft. Also if it's been over 10 years the statute of limitations have probably already passed which means if they would try to sue you over it you could claim the SOL as an affirmative defense and get the case dismissed. Also SSI is a non attachable income source, meaning that even if they could obtain a judgment they would not be able to garnish your SSI.

I have gotten calls regarding a debt (identity theft), that was brought to court and a judgement was made in 2002. The amount was for $3,900.00 and was said to have been handled by FNCB on behalf of Credigy. This company is extremely rude and refuses to work with me in a legit way. Also I am worried about their horrible reputation. I own no property, live in NYC. What should I do?

Everyone should know, they should NEVER pay a debt collection agency for any debt owed. If you want to clear your credit report and make good on any debt you may have outstanding, you contact your original creditor directly and make arrangements with them. Many times, after a certain amount of time, the original creditor has written off your bad debt and the collection agency buys that bad debt for pennies on the dollar. They then harass the consumers until they get paid, unless you stop them, as per your rights under the Fair Debt Collections Practices Act. To put it in perspective, say you have an outstanding debt for $10,000 to GMAC. GMAC, knowing that chances are good they will not be able to collect the money, charges off your bad debt and marks your credit report as unpaid/charged off. FNCB, or any other collection agency, will purchase that bad debt from GMAC for $2500. Now they contact the consumer and attempt to offer you a fantastic sounding settlement offer. Use the example of the one they offered me for 60% off the original debt. They attempt to collect $4000. If I pay FNCB, they will have made a profit of $1500. Your original creditor NEVER sees that money, and your credit report STILL shows GMAC as an uncollected/charged off debt. All you have to do to get these collection agencies off your tail is to send them a certified letter, return receipt, telling them briefly that you do not owe them any money and to cease all communication attempts with you. You can then threaten them with seeking legal counsel. They are, by law, only allowed to contact you one more time to advise you that they will not contact you again. It's that simple. If they do continue to harass you, you do have the right to sue them. Just make sure you have detailed records on their attempts at contacting you (i.e., letters and phone calls). Hope this helps!

I would suggest that before you fire off C&D's left and right that you verify that the debts are out of statute. If you send a C&D and the CA(JDB) still has the legal right to sue, their next communication may be in the form of a summons.

NEVER make a payment to a collection agency!
(1)Find out who you owed the money too originally (the Original Creditor) and pay them only! To stop collection calls: (2) Tell the collection agency you are NOT the person they intended to contact, and say you have never heard of the person they are asking for, that you just got this telephone # and by law they have to take your # out of their system. (3) When you receive a collection letter from an agency, IMMEDIATELY send them a "Cease & Desist" letter. You CANNOT call them ... the "Cease & Desisit" MUST be in writing. You can GOOGLE a form letter. Make sure to note in the letter you will ONLY deal with the "Original Creditor" and if that you will consider any further contact from the Collection Agency as harassment, and will notify the Attorney General in their state, and your state, as well as the Federal Trade Commission (FTC). -Law guy |

What if there is a debt you'd like to dispute but it's been more than 30 days since you were first contacted by that credit agency? Can you still contact them for a verification? This would be for a debt that has not expired according to SOL.
