Default FNCB

6 1/2 years ago, we settled with all our credit card companies and paid the agreed amounts. The balances were supposedly "charged off". We received notices from them at tax time that it had to be reported on our income tax return. Therefore the SOL on those debts supposedly expired in 2006 (4 years SOL in New York).
3 years ago we moved to another state. I heard a rumor that if you move to another state, the SOL is revived and collection agencies can collect the charge offs.
We have recently been receiving calls from 2 numbers of this collection bureau. They don't leave any message, but just keep calling. When I arrive home, their caller IDs are on the phone, but no message so I do not know if they are calling for us or for someone who had this number before us.
Can they collect the charge off amounts and does the SOL revive if you move to another state? Isn't the debt dormant after 7 years in any case? Seven years would be 2009 so I think that is why they are going crazy with these calls at this time.
Thanks for anyone who knows the answers and can ease my mind or give me the true facts.

Default FIRST NATIONAL COLLECTION BUREAU

I rec'd a letter from these people stating that there was a judgement against me in '02 for $5100.00. There has been no attempt to collect on this since then Now they are telling me that I owe over $10,000.00. I have not been hard to find, I have worked at the same location for 18 years. Is this legal for them to pump this debt up so much? I am in California and I understand the SOL is 10 years.

Check with the county clerk to see if a judgement was entered against you in 2002, the CA could be lying. Send FNCB a DV letter CMRRR make them prove they own the debt and have the right to collect it.

SOL on judgements in CA is 10 years and can be renewed for another 10. There is also a statutory interest rate of 10% on judgements. Do the math and it is very possible for this to double in 7 years time.

He shuld have been informed when he was served, if he was served. 7 years later, I don't know if he has grounds to vacate due to improper service.

Pandad62...did a judgement ever appear on your credit report

Default Statute of Limitations for Florida

I received a letter from these people and am wondering what the SOL is for Florida. This bill is at least 7-8 years old and i am wondering if i can still be held accountable for this bill.

to all about sol by state
depending on state laws you are correct but also just because the debt isnt on the credit report doesnt mean that the balance is still owed its up to you all if you want to pay or not, also on judgments before you start claiming outta statute for your state or claims 7yrs or older maybe you should do your own resurch about this judgment before you make anything rash
judgments can lien a house, bank account, poss wage attachment in most states, judgments are court ordered n are extremley hard to get overturned..

good luck to all

Default Scam and statutes

You can Google and find the statutes by state, but if it is a judgment, that is a different matter. Don Landers is actually a nice guy, he get's defensive when treated offensively...this I know.

First National Collection Bureau services the debt, they do not own it. Just wanted to be clear.

If you do not owe a bill, don't pay it. If you do, just work something out--- no one will be terribly unreasonable.

If you have a problem with the way you are treated, just ask for a manager and be sure to know that proper communication is a two-way street. No one likes to be collected from, and that is obvious. There are bad agencies out there that give a bad name to the whole industry, but First National Collection Bureau is not at all like those.

I received a call from this company this morning. Funny thing, they asked for me by my maiden name - which I haven't had in nearly 10 years and no longer use on anything. So, right away, I know they are calling about some supposed ancient debt that is well past the SOL. I am not going to return their call and will wait to see if they call again.
