The debt they leave a message to me about (I never answer unknown callers) is way past the SOL in PA. It is not on my credit report anymore and is in my maiden name (over 11 years), but I am afraid to have any contact whatsoever, fearing that it will start the SOL over again.

Answering the phone by itself won't reset SOL. Verify your address and inform them they have 5 days to send you details of the debt. Respond with a full cease comm letter only if it is indeed beyond SOL and federal reporting period.

I just fear any communication with them at all. Do I really want them to have my current address? What do I put in a full cease comm letter? It was removed from my credit report when I requested due to it being longer than 7 years old. I think the SOL in PA is 4 years and the last activity on this account can in no way be less than 9 years ago.

Man, they won't settle with me. I agreed to pay them $150 a month on a $2600 Merchant's Discover card, and I just took a good bit out of my 401k to pay down my debt. I offered $2100 and they say their client refused; they want the entire amount. Any ideas as to my options?
Thanks. |

I have been getting letters from these ppl for over a year now the last 1 I got was very rude stating I need to pay this asap and do not make them take any fruther actions to collect this debt. So I called and told them to do whatever they needed to do to fruther collect this debt I was very pissed. And they try to sit there and argue with you ab the situation. But I saw that there is an address posted but mines not the same as the 1s posted here ?!?!

Yep, after the SOL they cannot enforce collection in court but that doesn't always send them away for good. Send them a Cease & Desist letter.
chroma601, Keep at it. Don't give up. They don't really *have* to accept a settlement but most will, you just have to keep asking. Every time they say no to your settlement offer and do not counter-offer, then counter-offer for $1 more. Lather. Rinse. Repeat. Get everything in writing. Guest, they are required by law to mail you a letter with some detail about the alleged debt and it source, called a dunning letter. Until you receive that, do not engage them. |

There is no SOL for attempting to collect on an unpaid debt unless you live in MS or WI so, yes, it's probably legal. They have the right to ask, you have the right to tell them to pound sand.
