Why is Innovis exempt

While do a little research for some on the forum this morning, I stumbled across the website of Innovis the forth , less well known CRA. You can order your Credit report from them, but they apparently feel they are exempt from the FACT act and charge a $10 for it. Anyone have any idea why they would be any different from any other Consumer reporting agency?

Something tells me this is going to one people will need to watch out for, as they apparently think they are above the law.

I know of people who have just written a letter and requested a copy under FACTA...I think they just get away with it because they are not one of the big 3.

Well, we'll see what happens I sent my request off today, and said if I cannot have one free then I want an explanation as to why they feel they are exempt( which of course will be turned over to the FTC).

I was checking their website. It is stated there that the first report is free for the residents of Colorado, Connecticut, Maine, Maryland, Massachusetts, New Jersey and Vermont. And residents of Georgia are eligible to receive first and second report for free. They have not mentioned anything about annual free report.

Now let me quote one paragraph from FCRA:

Quote:
In addition, by September 2005 all consumers will be entitled to one free disclosure every 12 months upon request from each nationwide credit bureau and from nationwide specialty consumer reporting agencies.

IMO, Innovis aka Innovis Data Solution does not fall in either of the categories nationwide credit bureau and nationwide specialty consumer reporting agency. I have no idea what is meant by the term specialty consumer reporting agency. Does it mean an agency solely dedicated for credit reporting?

Well, I think Innovis does fall under the FACT act, as Sallie Mae reports to them if you are late paying (along with the other three) and I occasionally hear references to the FOUR national credit reporting bureaus, with vague references to Innovis. If your call the Opt Out line, they say you are Opting out from the FOUR national Agencies, and Innovis is included in that list.

I believe a "specialty" consumer reporting agency would be something like TeleCheck, or SCAN network, both which have instructions on their website to request your report under the FACT act.
