I recently had to deal with these horrible people. An investigator Roebuck started calling my husband's place of work and making threats. I tried to call to find out any information and give the man the proper call back phone numbers to us. He was rude and obnoxious. He wouldn't take any information from me and wanted to speak to my husband. We called him the next day, and he had already called my husband's boss and made it sound like he was in jail for fraud. We are in the middle of a BK and our lawyer handled this very well for us. Bottom line is....these people are just a collection agency that has a big vocabulary. They try to intimidate you into paying. They are in no way affiliated with the Florida District Attorney's office.

No they are not affiliated with the Florida District Attorney's Office but there is a pending lawsuit that I have sent in an affidavit to become a part of. I believe that you should do the same.

Recently, I wrote a letter on your behalf to the above-named company requesting a response to the allegations made in your complaint. Enclosed is a copy of the reply we received from them.
I understand this explanation may not be satisfactory to you. Unfortunately I am unable to take further action to resolve your complaint through informal mediation. Should you decide this explanation is unacceptable, we would then suggest you contact an attorney in private practice to determine what avenues of relief may be available to you.
I regret we can be of no further assistance to you in this matter. Your file will remain a part of our permanent record. Attorney General Petro thanks you for bringing potential violators of Ohio's consumer protection laws to our attention.

Attached to this was the response from Ellis Crosby and Associates which stated:
"This letter will serve as a response to the complaint submitted by Ms. Jodi Gardner. Her greivance has a number of discrepancies with the accuracy of how we conduct our business of collections on an everyday basis. Furthermore, some statements in the complaint are complete fabrications that I need to address.
It is a fact that our office did contact Ms. Gardner on or about the date of September 14, 2005. It is a fact that we attempted to collect a debt from Ms. Gardner. However, it is untrue in every fashion that we advised Ms. Gardner that we intended to have her arrested as some sort of criminal investigation brought about my several unpaid, unsolicited personal loans initiated off the internet with our client. This claim brought by Ms. Gardner is completely preposterous.
The business of collections is a difficult one, in the fact that there are hardly ever any satisfied customers. Many times the collection conversations undertaken by any collection agency can become combative in nature and difficult for both parties."
As you can see I have been made out to feel as if I have done the wrong thing when I never denied owing the money just the way the collection agency approached me and threatened me.
Any thoughts on this by anyone. Do we still have a chance with the Florida Attorney General's Office?
Please let me know what everybody thinks of this response.

The attorney general from Ohio has responded to what was submitted to them by Ellis Crosby. They also understand as it is clear from their post that you have brought out the company involved in illegal activities.
Moreover, there are large number of complaints against Ellis Crosby using threats of arrest and they just can't deny it though one single complaint of yours.
I assume that the Ohio attorney general was not able to take many actions against this company as it is based in Florida. But the Florida attorney general has gone far ahead with this case and we will be hearing from them very soon.
Keep up the good work in bringing out such companies not following the federal laws so that some authorities are able to take actions against them.

I did also file with the Attorney General's Office in Florida and submitted an Affidavit. Just wondering if we'll ever see any of the extra $$$ that we paid to Ellis & Crosby.
I know that I had a debt to pay but the way they treated you and the extra $$$ they took is pure robbery.
Thanks for responding and please update on the status of the law suit pending against them.

As we all know that Attorney General Charlie Christ has filed lawsuit against Ellis Crosby and the court hearing is supposed to take place in the month of December, he commented that the tactics used by Ellis Crosby against the US citizens couldn't be described in words. They were harsh on the people and posed as police and charged illegal fees. Ted Ellis Crosby was in violation of multiple laws of the fdcpa and has to face legal actions surely.

Was glad to hear that Charlie Crist , attorney general for the state of florida is now in the process of taking this company to court for the illegal tactics that they use againest consumers- shoudl be no time before this company is punished for the wrongful tactics as quoted by Ktate but I really wonder if they will quit their illegal process of collecting debt. I wonder if he will collect the Affidavit that I forwarded to the other person that was in charge.

Do you know the FTC filed penalty charges on NCO collection agency some time back? The company was charged $1.5 million for illegal activities like re-aging the accounts, reporting later than actual dates of delinquency. Now, NCO has to show every agreement to the FTC for supervision. I hope the same for Ellis Crosby too.

Does what you state, Ben, mean anything to us? I do't believe that we'll ever see that extra money that they charged us. I have learned from my mistake but it would be nice to have the fee money that they overcharged me back and not only that but the piece of mind that no one will ever scare me or treat me like they did ever again!!!

I feel that the government will arrange some restitution as it was done in the case of NCO some time back.

Any idea on how long that took to get restitution since this really has not gone to court and won't until next month, correct. It would be really nice, I'm sure everyone who has been attacked by these people to have this money for Christmas.
I am so glad I found this forum and have people to talk to that have the same situation as I do...

I feel that the decision on restitution will be taken by the government only after court gives the orders. As we know that it won't reach there before December, we need to make other arrangements for Christmas.
