i receaved a c call from encore rmi on the 17th although they r a tad bit testy they are collecting on past due accts witch in my case i opened i pd my bill in full its the 24th and i have not recieved any opther calls in regards to my acct or any other "false" so what im getting at is pay ya dammm bills

Encore does ignore any and all cease call/validation demand letters. They have ignored my personal letter I have sent and again the demand letter from my attorney I have contracted. This is a + for me every time they call.
In my case, I have no idea as to why they are calling me,... we are in a hardship right now but my creditors have been working with me; at least I think they are. So, until I receive validation, I just keep documenting the calls building up my case. For such a business to ignore a potential lawsuit from an actual attorney, that is demanding validation, this tells me they have no brains and that their employees collecting must have a pretty bad daily life; they are using any phone number to call to take their frustrations out on whoever answers their auto dialers. If I owe this debt, then I will arrange to pay... but I need to know what the heck it is and I will not speak with an non-professional person; which is why I've demanded validation through US mail only. I will keep records of these calls and see them in court. (to date, they had 5+ violations by not responding to my letter... not sure what the violations are adding up to by them ignoring letters from a law office). |

I have been getting call from 888-821-6611 with no one on the other end. They keep telling me to give a call back and when I do there is no one available and their voicemail boxes are full. If anyone has more information about this annoying situation please enlighten me.

This company does not care about the collection laws. I sent them a No Contact letter by Priority Mail, Signature Confirmation which was received on 7/28/08 and I received a call tonight from them, 8/4/08. Watch out for this company....they tried to bully you into something you can't do.

Ok... I work for Encore (A CONVERGYS owned company ) Of course Convergys don't want anyone to know that, because convergys might get a bad-rep.
I have been there less then a month and it's down right shady what they do. But to clear a few thing's up, They can call you ALL DAY if they want because they are NOT a third party debt collector. Cap. One, Dell, GE, Chrysler, WHO-EVER. Hire's Encore directly as their "Finance Dept." thus making it 1st party collections. So most of the fdcpa rules and guide lines DO NOT apply to Encore. They train us to be rude and demanding. |

I used to work for Encore for 5 years. They used to be a great company when A.L. Summerlin owned them. They were bought out by Convergys quite some time ago and since then have just continually rolled downhill. They have (when I was there at least) lost several clients due to their unprofessionalism. Yes if it is 1st party collections they can do more than a 3rd party debt collector but they still have laws they have to abide by. I collected on business loans for Keybank before they pulled their business from Encore and we were a 1st party department and we still had to abide by the fdcpa. Encore no longer cares about the laws and that was starting when I left. They put everyone on auto dialers so the numbers are being dialed and they sit and scream at everyone to hurry up and pick up the lines that are dialing out (sometimes they set the dialer too fast and not enough people are there so it calls 20 people and has them holding on the line while everyone is talking to other customers so that is why several people have got calls and no one is on the line when you pick up- if you really want to speak to someone then you can wait but you probably don't lol). They intentionally tell their employees to NOT leave messages because that is their little way around the law... if you don't leave a message no one can prove they have already called that day therefore they can continually call back. Also, most of the time they say you are speaking to a manager it is not really a manager. They just have you grab the person next to you and put them on the phone to "talk off" the account because they have TONS of people there and if the manager got on the phone for EVERY complaint they would never get off the phone. The only time they actually leave messages or follow the law is when the client is on-site listening in on their calls. The best thing for you to do if they are calling saying they are collecting as first party is to contact the business themselves and let them know of the shady things they are doing and then the company can go audit your account and check the dialer records and see that they have called you ten times in a day and trust me ... it pisses them off. The businesses have no idea because when they come for on-site visits everyone acts completely different and all the rules change. They have lost clients before simply because they learned how shady they truly were. Now if it isn't first party collections that means that you must have got EXTREMELY behind on your bill and they sold the debt to Encore and in that case they won't care if Encore is treating you badly but I can also tell you that if it is third party collections and they have sold your debt to Encore ... just ignore them. They can't sue you unless it is worth their time and money. It costs a lot of money to sue someone (trust me I know ... I ran the litigation team) so number 1 thing they look at is balance of a debt... if you don't owe more than what it will cost to sue you they won't do it. Number 2 - They have to verify where you are at to serve you to sue you so if you have never answered your phone or in any other way confirmed your residence they more than likely will not sue you. Number 3- The only things they can do when they sue you is put a lien on your home if you own one, Garnishment if they have verified your employment, or bank attachment which means if you have given them your checking account information they can TRY to randomly debit your account for the amount that is owed and if they overdraw your account who cares. Soooo.. basically.. don't give them any of your information. NEVER tell them where you work! NEVER use your checking account to pay (either use someone else's because they can't debit someone's account who isn't on the loan or pay with money order). If you own a home you may be in trouble lol. And never confirm your address. If you want to call them back.. call from someone else's phone and say someone gave you a message to call them.. don't tell them who or what phone number and tell them you don't have a phone. Also.. don't piss them off... the more they hate you the more the will try to get you somehow some way.. if they truly believe that you are broke and have no money they aren't going to waste their time... just play them. I'm not saying to let them cuss you out because honestly that is illegal anyway and you should just tape that and turn their butts in but if they are being civil and professional (which most of them aren't because their turn around rate on employees is insane and the people who do stay are there because they're unprofessional and no one else will hire them!) just tell them you have no money, no phone and are staying with friends. Don't give them your address... just give them someone else's address and tell them they can send correspondence there and those people will get it to you. If they call that person's house repeatedly all they have to do is say you don't live there and they have to stop calling. If all else fails.. SUE THEM... they are backed by a huge company so take them for all their worth but just keep in mind.... they treat their employees HORRIBLY so try not to take it out on the person you are talking to. I quit because once Convergys came in they couldn't give 2 sh*ts less about their employees anymore.. before that it was a nice small business with an owner who walked the floor and cared about his employees. I left in 2005 and still know people who work there and they are miserable and don't even get paid as well as we used to when A.L. owned it and get treated 300 times worse. They think everyone is expendable and they can just hire someone new and train them and pay them less than they paid you!
