Encore Receivable Management is harassing me. How to stop them?

Encore is one of the rudiest collection agencies I have ever dealt with. They would call from one place and claim to be callng from Kansas. The calls would start at 7:30am and wouldn't quit til after 10:00pm at night. When that was brought to the attention of Encore, they stated they were calling at the right times in their time zones. Wrongo, you have to go by the time zone in which the debtor lives. We have several recorded conversations where collectors from Encore stated they didn't have to go by the fdcpa laws and that they didn't have to obide by the cease and desist letters for they weren't 3rd party collectors. I received a letter from Capitol One apologizing for the actions by Encore Receivable.

and for the calls u receive wer u dont hear anything dats bec we are on a predictive dialer,, so u myt be at the other end of the line but we havent picked up the fone yet..

I just got my very first call ever from Encore. The call was for my wife, and Encore refused to tell me the nature of the call, or the nature of their buisness, as it was a matter they had to discuss with "my wife" not "me". They've already charmed the pants off me. I can't wait to deal with the next round. Expect more posts and probably questions from me. Thanks for the board.

^^^anyone care to guess why there are so many entry "mistakes"?^^^

How can the govt allow people like this to have access to our files???? Are there no rules for such jobs? Certain requirements such as the ability to make a complete sentence with less than 21% of the words derived from moron language??

This is how "mr smith" gets his credit screwed for "mr smithersons" debt.

Well I see that I am not the only person being harassed by Encore. I received 11 pre-recorded messages in one day. The y continued to call after I agreed to payment arrangements, on the sdame day and the next. I file a complaint with the FTC and will send a cease and desist letter via certified mail. They are over the top and so annoying.

Real quick, before the bashing starts... I have spent over 3 years at encore and they have been some of the best of my life... I have learned a lot and I'm going to give you all some insight that I feel you should know, and maybe, just maybe after you hear what I have to say, your still not going to like us, but you will understand a little more of where we come from...

Which ever collector is typing on this forum, please stop! I appreciate your effort to explain how we operate... but your making us look like idiots.

Before I start really breaking everything down, I want you to understand a few things... There is not a single collector at encore that I know, that enjoys hitting up a 90 year old women, who her husband has passed away and now she can not pay her bill. Notice the words can not and instead of hasn’t... However, on the flip side as a collector and even now as a manager I LOVE ripping into someone who charged a 3000 dollar balance and are first payment default (never made a payment)

My mom is getting the same type of call on her cell phone. The only difference is there is no number with these calls and as soon as she answers it clicks. She was thinking it was because instead of a regular ring she has a song for her ringtone. It would be nice to figure out who is calling and for what bill though.

Encore Manager, you will have a lot more validity on the forum if you learn how to spell, i.e. Tommy Hilfiger, not Hillfigure. Sorry but people will think you're not trying to be helpful if you don't spell correctly.

Please stay with us and try to help those they are plagued by collections and really truly trying to pay their bills. We welcome collectors who try to help.

The number is 888-447-4169, in their system, the last names and zip codes have been sequentially arranged. I have heard that when they try to collect a debt from a family having the same last name and zip code, if they have left the country, they start contacting the following person without any written correspondence.

False - we do not associate last names with zips, we do contact relatives to collect the debt however we do contact friends/family in attempts to locate the card holder

Before you start payment towards your debt account, you need to know if it is with the creditors or is it sold to the outside collection agency. In your case, whoever is holding the account, they can only be paid and not the other party.

False – we collect for Capone we are a 3rd party however due to Capone’s size an internal group would be counterproductive they outsource there pre-recovery accounts to third parties and pays us a flat fee each month we do not receive commission off your account. When you set up payments with us you are paying Capone directly we only assist in setting up the check by phone you even write the check out to Capone

If the collection agency is holding the account in valid terms, they will produce the debt validation details before you consider paying them.

False – all disputes need to be done with merchant, general correspondence, and or fraud dept. each number listed on Capone website… further more mom of twins… More then likely the manager you spoke with was attempting to verify your info to send account to fraud, however with the account being in skip I have the feeling the bill had been paid at one time (not typical of fraud accounts) and the previous number and address associated with the account were no longer valid. In other words you moved and didn’t update your info, didn’t get statements, didn’t make payments.

Tape recording calls….
Most states you most announce it at beginning of call or it is not valid its called a Miranda, however it is our company policy for the rep to disconnect the call due to Card holders purposely trying to get representatives to break the law… this doesn’t sound like your scenario it sounds like you taped them for your records…

Encore is now calling me from 888-785-7719. I called back and again the woman just asked for my account# I asked who she was she said encore asked who is encore she said per federal law can't tell me anymore without my name I advised I was not going to give my name until I got more info other than just encore

True – until you verify 6 points of info were not going to tell you any more then that! WHY? To protect the consumers privacy anyone can call from your home phone how would you feel if at thanksgiving your mother saw a missed call on your caller ID got curios/nosey and called us and the first words out of a persons mouth were “your accounts in collections you haven’t made a payment In 112 days and at this point your balance is due in full” – personal business I really wouldn’t want anyone that picked up my phone to have access to
