Hello, I received a call at work from George Peter at United Federal Bank (Tel: 908-212-3726), saying he was calling to collect on a payday loan I supposedly had from Electronic Payment Processing back in April 2005. This dude could barely speak English, and was clearly reading from a script on how he was collecting and expected me to pay $685 by 11 am. I tried to explain my rights under fdcpa and that he needs to send me written validation before I pay them a dime, he said no he doesn't need to send me written validation because I signed a contract with Electronic Payment Processing, etc...I explained that they are not the original creditor, and yes they do need to send me written validation, and we went round and round. I asked to speak with his supervisor in the hopes I could understand him better, but unfortunately, his English was just as bad. I ended up hanging up on them, and have not found anything on Electronic Payment Processing or United Federal Bank on the internet that is helpful. So I turn to you....what names does Electronic Payment Processing loan under, I have checked back through my records and am coming up empty. Any help you can offer would be greatly appreciated! I could not find any information about Electronic Payment Processing. However, I do have an address and phone number. Chances are (Electronic Payment Processing) is the name of the collection company. However, the area code 908 is in New Jersey. United Federal Bank is NOT listed anywhere, and could be a dummy bank.

Thanks, Mike. Did I do the right thing in demanding that United Federal Bank send me written validation, in view of the fact they are not the original creditor? I was burned big time by Ellis Crosby and Associates, and I will not let a creditor or collection agent intimidate me again! Thanks again, Melissa

Absolutely! You never know when an individual will call up and tell you to wire money to Jon Smith & Associates. You have to protect yourself, and your money. They should also have your address if they properly own the account.

You are correct. If this is your first contact with Electronic Payment Processing, they should send you validation...along with the signed contract. The signed contract alone would serve as proof of loan. But there should also be a breakdown of the amount due.
This is all very difficult, as it will just sit on your credit file if it is there. So perhaps you can convince them to mail you validation the next time they call. Maybe mentioning that all incoming calls are recorded on your line will serve as a "wake up" call to them. Sometimes collection companies are operating illegally, so they have no way of sending validation.
Do you remember such loan you might have taken out during that time. Maybe you could try calling the original creditor.

United Federal Bank is the new Ellis Crosby.....I have been contacted repeatedly by these folks at my place of employment, after specifically asking them not to call me there. Each time they threaten to have papers transmitted to my local court house, blah blah. Each time I have told them I have a payment arrangement set up with another collection agency to pay off this payday loan, and they continue to tell me that if I don't want to work it out they will take further action....which seems to be unending telephone calls. I have tried repeatedly to talk to these folks, and (I'm not being fresh) they don't seem to understand English very well and are obviously reading from a script....any questions throw them for a loop. Today they called me from a new telephone number, 561-210-5357, which is in Florida. I have filed a complaint with the Better Business Bureau and the Florida Attorney General's office, reporting this companie's apparent lack of understanding or comprehension of the fdcpa. I plan to call them after work to inform them of my actions, and hopefully they will get the message. I have documentation of everything....unfortunately, I had to learn the hard way via dealing with Ellis Crosby, so I am ready for these scumbags. And thanks to all on this forum for giving me the knowledge and strength to defend myself against predatory lenders and collection agencies. DOWN WITH PAYDAY LOANS....don't EVER take one out!!!! Melissa, have you sent the cease and desist letter to United Federal Bank by now? If you always tell them verbally to stop calling you, they won't give it any importance. It is because nothing can be proven that they are violating the laws. But if you have sent a cease and desist letter and thereafter they call you, the company violated the fdcpa rule. At that point, you can try to make your point stronger by recording the phone calls also. Check the statutes in your state before you take this action. Most states allow the recording to be done secretly. Whereas in some states, you will have to take both the party's permission. If you don't take their consent before recording the calls in these states, your case will become weaker.
Deal with collection agencies knowing your legal rights. Most of them think that people lack the legal knowledge and can be victimized. And because of financial problems, most of us can't bear the expenses in a lawsuit. Due to these facts, they really prey on us. We need to make our approach stronger and do everything according to the law.

There is no such bank my this name. I checked into this when IWCB called and used that name. I called the Div of Banking in WY and no such bank. They are also using another bank which has the Federal Bank in the name again no such bank.

I got the same call every single day harrasiming me to pay them off within 2 days. I ask them to send me some kind off document or a receipt saying that I have to pay off this kind of amount but they wont give me anything. Anyway do you think this loan center is valid and not a hoax.

I too am getting harrassing calls from United Federal Bank on my job for the past two weeks. THe first time they tried to get me to pay by 5 that evening an I told them that there was no way that I can pay 819 dollars. They threatened me that they would send the police to get me if I did not pay plus they had all of my personal information. Then they called again by the United Federal Dept a week later and told me that I have a week to come up with 830 dollars. I told them to send me some type of documents stating thatI owed them for this so-called "Payday Loan" and they told me that they would e-mail it to me by yesterday at noon. I have yet to receive this document. I was just going to contact someone to look at my credit report and just have it repaired and if I do owe anyone, then I will take care of it that way. Any suggestions helpful.

Kera,
Make sure that United Federal Bank has your accurate account details. If they are trying to make a false collection and have hit your file fraudulently, you must dispute with the bureau immediately. Remember, collections are derogatory remarks in your file. If the company has reported without valid info, you have a legal case against them.

I had a run in with United Federal Dept, a.k.a. United Federal Bank but listed as Focal Communications today. When I contacted them to let them know that their practices were against the law. I could not get an address out of the gentleman who answered the phone and had to deal with him being very defensive when I represented myself as legal counsel. These folks are obviously not from the states and are using whatever tactics they can to scare people into giving them money. I encourage everyone who has been terrorized by this company to file a complaint with the F.B.I and the Better Business Bureau for harrassment. The last I remember there was a law against predatory lending and credit collectors harrasing people. This madness has got to stop, unfortunately my sister was a victim of their scam.

I am very upset! In august i received a very disturbing phone call for a "mike scott" from united federal bank. He informed me that if i did not send him $350 that the sheriff's department would come up to my job and arrest me for theft. Of course, i bought into it and paid them $350 plus a $5.00 fee to debit the funds from my account. Every since then i have been harrassed by "mike scott" and his associates to pay them an additional $230 or they will pursue legal action against me. On several occasions i have tried to get documentation from them and i have been told that i will not receive any documents until i satisfy the debt and maybe they will send me something. Today, "mike scott" contacted me and told me that he would be debiting the $230 from my account and if i didnt let him he would go forth with pressing charges against me. That was my breaking point. I contacted someone who has knowledge of laws concerning this matter and she told me that what they are doing is illegal! I have decided to begin an investigation into this company and take some legal action of my own, im tired of being a victim!!!
