I, like many others on this board, received a phone call today that shocked the heck out of me. I was phoned by this guy who was obviously from a foreign country who told me that I had 30 minutes to call him back, that he had my IP address on file and that I had taken out a payday loan with his company and not paid it back.
He told me criminal charges were going to be filed for bank fraud because I closed my account. I told him to hold it, for I didn't close the account---HIS company kept on hitting it over and over repeatedly and on dates other than those originally agreed upon until my credit union of 16 years finally closed the account themselves. He gave me a "case number" and a 908-212-3726 number to call him back. I've never had a criminal complaint alleged against me, and the ONLY reason I resorted to payday loans was because my mom had an acute heart attack in January and she already has COPD. I explained this situation to the guy and said I'd be more than glad to work out a payment plan, but he would have none of it. I was shaken, then mad. I called the FTC and filed a complaint, then called a nonprofit consortium to stop predatory lending in Durham, NC and am awaiting a return phone call. Additionally, I called the CUNA and explained the situation to them. Everyone involved says, matter-of-factly that this company VIOLATED the law by harrassing me to the point of exasperation and by accusing me of a crime when I've never so committed one. One thing is certain---I WILL work to see that Payday lenders are run OUT of America. They're as bad as the Taliban and their members actually sound like the Taliban!
