Default a collection agency collecting for collection agency?

I guess I haven't thought of this, but does a collection agency hire another collection agency to collect its money? My husband has an account with Fingerhut which I am currently paying on through Phillips & Cohen. Fingerhut is showing bad debt---write off. Phillips & cohen are not on credit report. but Fingerhut has a second entry on credit report under midland credit management. They are also showing 'collection Account--making payments'. So fingerhut will stay bad on my report but midland will end up showing that its been paid off? anything to dispute here with credit bureau?
I mean, at least if the collection agency is going to be on there, its showing that its being paid. so Fingerhut ends up being posted twice? I'm just asking cause this is the only collection agency on report. thanks-shirley

that's odd. i've never heard of a collection agency hiring another collection agency. you might want to verify that midland credit is not another agency entirely? it's possible fingerhut sent the debt to another agency and both are now reporting. however, it is my understanding that a debt may only be reported to your credit ONCE at a time. i believe you CANNOT have multiple agencies reporting on the same debt all at the same time.

Hi Tania,

Thanks for appreciating the website. You can also join the community and be an active member in the forums. Your registration is free here.

Regarding the investigation, have you placed your complaint at the consumer protection office in your area? It will be more helpful if you can send the info to them also so that they can investigate it.

Shirley,

A collection agency can report in the credit report only if it has a legitimate reason. If the two companies are entirely different, one should stay in your file after you have paid them off and the other one needs to be removed. It's because two companies cannot report for the same account at the same time.

This gives you reason to place a dispute with the CRA.

Tania,

There is not the slightest need to face the abuse of the debt collectors. Have you done something wrong for which they are harassing you? No. If they are collecting for some past account, they should show you the documentation first.

Show your proof to the attorney general. Laws are there to protect the consumers, not to support the illegal activities. Send copies of your complaint to the FTC and the BBB also. They also will be sure to take legal actions against the rude debt collectors.

Regards
Roxette

I did question them about the fingerhut account being on twice. we'll wait and see what happens. LOL I'll have alot to post about when I hear back from them about all these disputes! There were several! I explained each one and whats been going on with it. It ended up being four pages. I don't know if it will change anything or not. we'll see. will let the group know what I find out, when they start coming back in.

something else I thought of. what if one bureau clears something but the others don't?? how is that handled and does it happen? Or like if two don't and one does? interesting question, I think.

thanks, shirley

It is up to the creditor's choice of which credit bureau they are reporting to. Although these credit bureaus share information within themselves, but if due to some reason, your information is not updated with the particular bureau, you can request them to update the file. They will do the needful.

Default collections

I have some medical bills in the neighborhood of $5.000. From my Gall Bladder removal. So there are like three-different doctors and the hospital and clinic billing me separate each month. I only make $8.00 an hour and each of these bills are over a thousand dollars and they all want 10% of that each month in addition to car insurance, food and rent. I have been sending them all $25.00 a month since last June of 2005..never missed a payment. Now one of them has referred my account to a collection agency who is demanding payment...and threatening garnishment. I only get back $900.00 and change after taxes. So what are you suppose to do?

Heres what comes to mind while reading your post. If I understood you right, you have been sending each of each accounts $25 a month? Only now one has went on to a collection agency. I take it that the collection agency has contacted you since you said they are threatening garnishment.

Okay, if I were in your shoes, I would sit down and write collection agency a letter and express that due to hardship, there is just no way you can pay the full amount at this time, but would like to reach a
payment plan/agreement that would be satisfactory to both parties. I would still send the $25 a month that you are sending the others (unless you can afford to send more), and if somewhere down the line you hear from another collection agency concerning one of the other accounts, then deal with them in the same way.

Also, I have found from experience that some of the worst collection agencies to deal with, are the ones that are holding medical accounts. So for your own protection, at the bottom of your letter, put in a 'do not call' order. Tell them to contact you through written correspondence ONLY, no phone calls to your home or to your work. Trust me, they will start calling you at your job, if they haven't already. If not, then you need to stop it before it starts.

hope I have been of some help. This advice is from my experience. Shirley
