I had a call today from a Mr. Scott from 1st Credit of America 800-293-1486 regarding a payday loan that I had from Apollo Funding. I have never received anything in writing regarding this debt. I asked him to send me something in writing showing this debt and he said that he didn't have to since it was in the "final stages." Okay, whatever that means. They are refusing to send me anything. He said that he could send me something in writing.
I received an email just stating that I spoke with him on this date and gave his phone number, nothing about the debt whatsoever.
I also told him that I could no longer receive calls at work and he said once I called him back tomorrow then he could not the file. Again, I told him NOT to phone me at work as I couldn't take the call. I emailed him back stating that I need something specific regarding the debt that I owe and to NOT telephone me but to send everything in writing.
I thought that they were out of Chicago, IL but he gave me this address 5700 Broadmore Suite 407, Mission, KS 66202. When I asked him for the address he hesitated for a minute before he gave it to me.
Of course I just got a rejection email back. All sounds kinda fishy to me.
Any suggestions on how to handle this? Thanks!

First Credit of America must send the details of the debt in writing. Since they are not doing it, send your debt validation letter covering the legal basis. Send it through certified mail and keep the green receipt in your folder.
Try to inquire the account with Apollo Funding. They might have hired this agency for collections. If they have your records in their system, your payment proposal might be accepted by them. You won't have to deal with the CA.

First Credit of America is one of the biggest fdcpa violators. They have to send a letter within 5 days of the call, which you will never receive. The final stages comment is what they use to get you to pay them. Send them a debt validation letter and a cease communication letter certified mail with return receipt. They are located in Chicago, IL. Also, file a complaint against them with the Attorney General in Illinois.

mail a demand for verification (also called a demand for validation). search the forums for messages about that, you'll learn more than you wanted to know.
