Under the Fair Debt Collection practices Act you have a right to request in WRITING that creditors (and sucessors in interest, i.e. collection agencies) not contact you over the phone. Again, this must be in WRITING. It works like a charm. You have rights too.

Well I actually spoke with them after "Robert Carmichael" left his somewhat funny pretentious tight **** message on my answering maching (I actually play it for company.. that's how funny it is). In any event when I did call them, they told me to get an attorney by Wednesday because they are going after me for an HSBC debit. I told them I intend to pay them, but since they don't want to take payments, which it proabaly would have been 5 payments, that they don't want to accept anything unless it's in full, so I told oh well, tough luck, you refuse to accept payment. So what should I do???? Can they "arrest" me and how much can they go after me???

I have been contacted numerous times by this company. When I answer the phone, I hear a hateful recording from Michael Nelson stating that I must call. I have spoken with a man named Mr. Johnson and a woman that did not give her name. The last time I returned their call was immediately after I received a call from Mr. Nelson. I asked to speak with Mr. Nelson but was told that he was not in. I ask why he just called if he was not in and was told that he was in a meeting. At this point I spoke with Mr. Johnson. Each time I have spoken with them, I have told them that I need something in writing and that I have no idea who they are. They told me that they sent a letter, but I explained that I never got it. They told me that they would not send me another letter. They also told me that I owe them 2,900 dollars and expect 2000 immediately. When I told them that I did not have that kind of money but that I had been paying consecutive payments, they told me that they did not care and then proceeded to call me names such as devil worshiper and stupid, scream at me, and imply that I was stupid because I did not have the money. They told me to borrow the money from a family member and that they would sue me if I did not. I explained that I had no family with that kind of money either. Again, I ask them to please send me something in writing and I was told no and was asked for my attorneys name and number. I told them no and that I would continue paying as I had been. At this time, the last person I spoke with, the woman, told me that she was hanging up the phone and was processing the request to sue me. This is when she hung up on me. This company was the rudest, meanest I have ever spoken with. I cannot imagine that they have the right to do what they have said especially since I am paying the bill monthly. I get numerous calls a day from this company.

I was originally dealing with Corporate Recievables, however my account has been sent back to HSBC (for a seaman's credit card) and HSBC sent it to a new collection agency (Leading Edge Solutions.
The guy I spoke to Angel Gracio was the NICEST individual, very compassionate, and he knew (from or conversation)that I do want to pay this debt (but he knows, I can not pay it in full.
My question is this 1. he said they will be charging me interest (it's a new law) for everyday it's in collection is this true?
and 2. if HSBC took back the account can't I pay them directly?

credit cards, debt, or any other financial matters are like any other legal matter whether civil or otherwise. if you have truly taken care of your business, i.e. "paid your bills on time and in full" you would not have to worry about who is calling or why. you could then calmly answer the phone and politely correct the caller(s) with absolute certainty they are calling in error. just like you would if a police officer pulled you over and you know you have done nothing illegal. p.s. callback the toll free 800 number it is free and inquire politely and professionally about who they are calling for and why if they are not looking for you then simply tell them they have the wrong number and ask them politely not to call your number and remove it. do not lie if they are looking for someone that you know and you have a clue that they why they are calling as this will not make the debt/problem go away. it will only get worst. this is what L7 people do. "Losers" who really don't pay all their bills on time and run up all sorts of debt and then have to worry if someone has caught up to them. if this is you then your day will come when your friends and family even co workers will discover what a "loser" you really are.

Thanks, guys! I'm so glad you gave me the straight story! I owe no one anything, my credit score is like 900, and these tools have been harassing me as well. I will block their number and never call back, and file a complaint with the Attorney General's Office. I am a generally sweet-tempered guy, but I am extremely tenacious, and I really enjoy going after companies like this, who are typically stupid and do not have the resources to deal with people like me. Man, did this company mess with the wrong person!

My husband has been dealing with them on a debt that was written off by the company it was originally with back in 1989. That company I might add is out of business now. Rude is an understatment. They have harrased his 80 yr old parents who live in another state somehow they have gotten my name and Ms. Seay asked me today if I had told my husband about our conversation from a few days ago. I have never spoken to this company at all and the only reason I answered was to inform them a cease and desist letter had been mailed and we had filed a compaint with the FTC as well as the Illinois Attorney General. She would not even tell me how she got my name and as soon as I told her about the letter being mailed she abruptly hung up on me. (trust me I was not done telling her a thing or two) Do some research and you will be suprised about the Statue of Limitations on debts. CHeck out this web site it is very helpful - bcsalliance.com. It gives you all the info you need on how old is to old. I have contacted an attorney and am now waiting to see what happens. Leading Edge has threaten to sue us as well as telling us on answering machine messages that say they are so and so from Law offices of Lerc and leaving Leading Edge's phone #(impersinating an attorney which is one of their scare tactics)

These so called "debt collectors" seem to be the worst of the lot. From what I read here, it seems they opperate from the position of harrassment, identity theft, intentional mis representation and more. Yet until the people stand up and require their law makers to address an issue nothing will be done.

With Me they were using the name Harvey Liebowitz. Also, about that Illinois lawsuit, they state that that case was lost(for what ever you can take their word) If I cant speak to the name on the paper like an responsible business would, then I dont talk. So guess what...
And clear conscience...sometimes WORKING individuals have circumstances that cause these things to happen. Like injuries, operations, etc. Combine that with employers who intentional hire too many so hours are kept too low to qualify for benefits(Like FMLA) and guess what? No money even though injured on job. So personally, I would thank You to refrain from judging others from around that silver spoon in your mouth. Thank You.
