You're not stupid, you're just learning! A cease and desist letter simply states that they not call you at home or at work. When I sent mine I said that I would not talk about payday loans over the phone and would not accept any calls from them, but I would be happy to respond to any emails or snail mails. There's no specific way it has to be written, but you might want to search the forums for cease and desist letter samples. It makes things a whole lot easier. Oh...And when you send them, make sure you send them by certified mail.

I am pretty sure Express Cash is the same as Cashnet500 who I have recently heard from. I will let you know if they try the jail angle on me.

OK PD6 Ventures/Xpress Cash sent this letter

-----Original Message-----
From: Brad Ragan
Sent: Friday, March 31, 2006 11:12 AM
To: Brad Ragan
Subject: Refusal to Pay
Importance: High

Please note: If you've already established a payment schedule please disregard. If a payment schedule has been agreed to but payments have been returned or declined then please complete forms attached and send payment immediately. Please forward this to you financial advisor if you need help with these forms.

The difficulties experienced by the collection department at PD6 Ventures/Express Cash when attempting to obtain the slightest amount of cooperation from you have led to your account status being changed to “Refusal to Pay/Intentional Neglect”.

This is a serious matter and all appropriate actions will be taken to collect this balance. Through your actions and lack of cooperation, it is evident that you have no intention of paying this account willingly and further actions must be taken.

Whether or not you considered it or not, borrowing money and intentionally neglecting to repay what was loaned to you is stealing. The consequences for the actions that you have taken were clearly explained in your signed loan contract. To avoid these consequences, return one of the attached authorization forms before 4:00pm CST today, March 31, 2006 so that this balance can be cleared without further incident. Fees will be added to your balance after 4:00pm CST.

If you have any questions about your account with PD6 Ventures/Express Cash, feel free to contact me by phone or email.

I RESPONDED TO THIS...

May 23, 2006

Hello Brad! Thank you for the letter! I am writing to inform you that I no longer am excepting phone calls from you or anyone else from XpressCash, PD6 Ventures, DMS Marketing, Express Cash or any of your affilates. Please do not call my work place!! This is the third time we told you that I cannot discuss personal information at work. The Owner and my boss told you on Friday, May 19,2006 that you are not to call me at work any longer. Please respect them and their business and do as they ask. This is my place of employment and if I have no job then it makes it harder for me to pay you back. I also do not appreciate being harassed and threatened. This is letter is a briefing of the certified one I sent to you and the owner of the company you are representing. I have also attached a few informational points to help further train you in your job and please feel free to share with your co-workers. Please remember, I may be a women but I did my research and I am not as dumb as you may think. I will pay back the loan, and you should see my first payment via money order in the next few days. Thank you for your time and enjoy the attached information!!

Sincerely,

Rachel Neiderhiser SEE BELOW

Looks like Brad is having fun with you.

Do not let him yank your chains. He is trying to get you all riled up and nervous. Just send in a payment when you can and make sure you keep records.

Just make payments you can afford. Keep letting Brad hang himself with his threats. Keep all emails sent from him in a safe place for future references.

Also, I want to add that I did not mean any disrespect with that "having fun with you" comment. That is part of Brad's job....to harrass, make threats, and makes you nervous.

ALso, it is illegal for a company to make threats and not follow through on them. (from what I understand). If the company is not licensed in your state, then they can not take you to court.

Also, if Brad threatens to report you to the local news, tell him to go right ahead!

Good for ya, Rachel! Stand your ground and always keep records of your payments. Save the emails. He blatantly broke the law by threatening you with the criminal prosecution.

Good luck!

First of all, don't worry about Xpress Cash, their threats are empty, as are all threats made by someone who comes after you under a small, unsecured loan. They can't do anything to you other than frazzle your nerves, unless you cooperate with them. So don't give them the satisfaction. Don't talk to them, don't respond to them no matter what. Close your bank account, and just write them off. They will do the same with you once they realize that you are not going to pay back their money. Once you start talking to them and agreeing with them and making deals with them you are setting yourself up for headaches. Xpress Cash is a very shady company, they have numerous complaints that have been filed against them with the MO BBB. I know of more than a few people who are bringing legal action against them. Again, they can only do stuff to you if you let them, these people are lowlife slimeballs, don't give them the chance. And while you are at it, why not take the opportunity to kick these people in the balls??

Don't worry about brad, he couldn't do anything to you even if he wanted to. Tell him to read the part of the agreement that says all disputes will be handled by an arbitrator. He can't read, so that does him no good. I was amazed at how literally stupid the people who work at the PDL companies are.. I mean really? Do they pull these people off the street? Crack houses? Jail? Fast food joints? Skid Row? The drunk tank? The Ozarks? Ok, maybe that is going too far, but it is fairly safe to say that most of these retards are people you wouldn't want in your house, they would probably stael something. Thats the kind of people you are dealing with here.. Don't give them the satisfaction.. Also, these places have an INSANE turnover rate, can you guess why? Must be a great job when you have to try to collect on people using dishonest tactics, etc. Not to mention, unless you get someone who buys into your crapola, you are nothing but a harmless paper tiger, LOL.

I know I'm responding to this late, but Xpress Cash did the exact same thing to me - from depositing money in the wrong account to threatening to have me arrested at work and all that crap. I hung up on them twice and everytime they call, i hang up. I'm not going to talk to them, and I suggest you don't either. Nobody is going to jail over a payday loan. If they did, I would have been locked up a long time ago being that I have fallen into their trap numerous times in the past! Pay the $200 and be done with it!
