xpress cash call me threatening legal action for a loan i never paid in march 2005 said it is check fraud when i never even signed any paper work!!

It is not check fraud with regard to a payday loan. They know they are taking a bad check when they allow the loan. This is the most common threat from these idiots.

So I have nothing to worry about?? I have been sick worrying that I am going to go to jail!!! First they wanted me to pay back 360.00 then it went down to 200.00. I talked to 2 different people in 1 day. I don't even remember the site or anything I got the loan from. Should I just pay the 200.00 or just let them do what they have to do??? i just don't want to go to jail over 200.00

does anyone know if XpressCash is legal in the State of PA. I looked it up and i didn't see it but ijust want to make sure so i know my rights when they callme again. Can I tell them they are not legal in my state to leave me alone??

You absolutely will NOT go to jail over $200..That much I promise you. If I were a gambler, I'd bet that xpress cash is not authorized to lend in Pa...I think there's a reason for why you couldn't find their licensing info. You've had the loan since 2005? How much have you paid on it?

Taking money from a company, legal in your state or not, and not paying it back is stealing.

If you haven't paying anyhting on it at all I suggest you being sending in what you can as soon as you can and continue to do so when you can until the loan is paid or settled in full.

You can check the licensing info of XpressCash with the Department of Finance/Attorney General of your state. The payday loan company should not have lent you the money if they are not licensed in your state. But if you have a loan from them, you will pay the principle amount along with permissible interest rates and finance charges. The interest cap in PA is 23%

FYI,
I don't think anyone is trying to steal. The point is to pay back what you OWE and interest allowed by law, not to pay a zillion percent interest on a loan of a few hundred dollars.

its best if you just talk with them and tell them that you are willing to pay back the loan and request a written statement of how much you owe them.
An operator telling you how much you owe a company is not what you should get. Get a written statement, like a recept.

Then begin paying it off. Or pay it off in full, what ever is the case.

Ahhhh poo on them! They have threatened me to no end with all sorts of tactics. Dare them to come get you and you'll have them thrown in jail without the key for their illegal practices.
I'd say get the deal in writing first, either by email,fax, or snail mail and sent the $200. Since they want to negotiate, there's some wiggle room to either get a payment arrangement or reduce the amount you owe if you've made some payments already.
Don't let them scare you, their just a voice on the phone.

Ask for the debt verification in writing. I just find it very shady that they call you NOW for the debt back in 2005? Ask for the proof that you owe them mo ney then go from there.


And...no you will not go to jail.

I have not paid anything back because since then i filed banruptcy and thought that xpress cash in included in that which it wasn't. i am willing to pay it back but not when they call me at work every 10 min and have 5 diffrent people doing the calling. first they accused the loan to be deposited into a bank account that i never even had the time they called my bank and all called the manager there a liar that that was the bank account the money was put in and well fought with them for a few hours and my boss until he told them to never call my work again so they finally called me at home (which they never once did before nor sent any letters) and said they are sorry that they had the wrong bank information, and get this they the guy was in the legal departmant at xpress cash and didn't even get the information correct.

You should send them a cease and desist letter. This will keep them from calling you. Then you should make payment arrangements. As long as you let them know what's going on and keep up your end of the bargain you shouldn't have too many problems with them.
