Tim vu, send a letter to the company's mailing address and resolve the accounts. If the accounts have been shown incorrectly in your file, they need to remove as it is hurting your credit. Send it in writing and keep a follow up. You must get your debt validated or else explain the bureaus that the accounts are disputed so that they can run an investigation.

Artie

LVNV Funding is a collection agency that gets hired by the creditors for some defaulted accounts. It seems that one of your unpaid accounts of the past has been sent to this collection agency for recovering payments.

Send a debt validation letter to LVNV FUNDING LLC asking for the details of the account for which they listed themselves in your file. The company must give you the details of the account for which your past creditor might have hired them. If they send you any details about the account, review it properly before you make a payment agreement.

If you find the item incorrectly shown in the statement, dispute on it. They will get the item verified with your original creditor.

From my experience with LVNV, they are a collection agency...but they do not try to do any collecting on their own...they send their accounts to various different CA's and attorneys to collect...yeah another example of a CA collecting for a CA.

I am dealing with this same company. Out of the blue I get a notice from them claiming I owe them money from 1991, using my married name, but I didn't even have my married name until '92. There is something very fishy about this company. Have you found out anything more?

Sandiduff...sounds like your account is out of the SOL period. Check and see what is the date of last activity on that account, if it is back in '91 or '92, it is clearly out of the SOL period. If you pay on it, that will start all over. As of right now, if it is out of the SOL, it can be disputed with the credit bureaus and removed from you report.

these are junk debt buyers they buy out of date and many times charged off debts for pennys on the dollar. ARI they are bad they are the lowest of the low and will use all kinds of tatics to harrass you.
the first thing you need to do is know the statue of limitations in your state, many times the SOL has expired and they will hope you do not know that.
i recieved a letter form them a few months back about a sprint bill that was over 8 years old stating that they are attempting to collect a debt for LVNV Funding LLC. <sherman>
The original debt was owed to Sprint.
The letter stating my outstanding debt of 561.46
It says they represent the above client LVNV,
Now it was a long time ago that I had sprint I would guess 8 years.
And I am really not sure that I had ever paid this debt off.
Anyway the letter is giving me three options to pay.

1) Is paying 50% of debt owed
2)three installments equivalent to 70% of total debt owed
3)monthly payments

there are a few options
1)send them via certified mail a debt validation letter this is where they must prove to you with original paperwork that you indeed owe said debt <many times they cannot produce this> i take no credit for this sample letter as it was takin froma website i had found.

To Whom It May Concern:

I have received your letter where you claim that I owe a debt to you and/or your company. This letter is being sent to you in response to your attached collection letter. This is not a refusal to pay, but a notice that your claim is being disputed by me. I do not recognize your company and I do not believe I owe you or your company this debt.

Under the Fair Debt Collections Practices Act (fdcpa), which I assume you are aware of, I have the right to request validation of the debt you say I owe you. I am requesting proof that I am indeed the party you are asking to pay this debt, and there is some contractual obligation which is binding on me to pay this debt. Below are a few questions to answer which may help you to resolve these mistakes.

In addition to the questionnaire below, please attach copies of:

· Agreement with any of your clients that grants you the authority to collect on this alleged debt

· Agreement that bears the signature of the alleged debtor wherein he agreed to pay the creditor.

· Any insurance claims been made by any creditor regarding this account

· Any judgments been obtained by any creditor regarding this account

Best regards,

whtlion, welcome on the board! You have offered your help to the people right from your first post. This is really great. We all will appreciate you showing active participation here and suggest with valuable ideas.

The debt collectors mainly prey on the innocent people who do not know much about handling their debt related problems. SOL is one of the weakest weapons for the debt collector when people are aware about the laws and the debt goes out of the statutes. It is a must that we should not make any payment without checking the SOL. Sometimes, age old debts do not need to stay in the credit report after 7 years. They also get deleted from the credit report after this period. But a collector suddenly contacts a person with this account and the person pays them in panic. This is all that the collector wanted. Not only the SOL has been renewed on this debt and all the legal collections have been valid, but also, this account will confirm its negative stay in the credit report for another set of years. And the worst part is that you will have to pay it in order to avoid any legal actions.

Know the statutes in your state before making any payment agreement.
