LVNV Funding LLC: What to do if you find them on your credit report

Having received a letter from a collections attorney I began researching LNVN FUNDING, LLC. Three states I have checked with so far are: Nevada, South Carolina & Delaware.

Please be advised, this company has been tracked back to the *State of Incorporation* as listed with the State of South Carolina. The State of Delawares, Office of Sevretary of State shows that there is not a listing for LNVN FUNDING,LLC in their databse.

Other tradenames,DBA's, states operating in, ect post them. They will be traced & listed on this forum.

How do you determine which state's SOL to use? Husband had a voluntary repo due to a divorce in 2001 while living in GA (SOL 6yr), however original loan was in SC (SOL 10yr). We now live in NC (SOL 3yr). LVNV showed up on CB this month. Shows 120 past due and opened in 10/06. I've ready alot but cannot find an answer to this. We are going to send a validation letter to make sure this is the repo since the amount is different. There was no correspondence as to a deficiency amount due and the original account on the CB shows charge off. Any help would be appreciated.

Hello all, I'm sort of new, if you haven't noticed. Thanks to all the wonderful information here, I now know how to dispute a claim with the evil entity that is LVNV FUNDING. I was wondering now, if anyone could help with directly disputing with the CRAs. Why only attack from one angle when I can attack from many? I guess what I need to know is 1)the form of letter to use and 2) where to send the dang ol'letters once I write them.

Ok, so I am reading all this info. Whew! I am an ABC/123 kinda person...
I have sent the certified DV letter and a dispute ltr to the CB who is reporting 120 days past due on a voluntary repo that is 7yrs old; 1 yr away from being removed from the CB. The SOL is 3yrs so that means it expired 4 years ago. CB score has dropped significantly and now other creditors are lowing credit limits which in turn lower score more. The other 2 CBs are only reporting as collection. If no verification is received how does a person go about changing this? Is the only way to sue in small claims court?

You can ask the credit bureau to give results of the investigations when you disputed the item. They will have to provide proof when they still continue to report the item you disputed earlier. If you have documents to prove that the credit bureau is reporting the item incorrectly even after showing proof, speak with an attorney. He will help you in filing a lawsuit.

LVNV Funding appears on my credit report. They purchased it from Sears. The account however was closed in 2000. My report says that last activity with Sears was Aug 2003. LVNV has the account opened April of 2004. Do I still have a legitimate complaint against them?

For you guys that have just noted lvnv funding llc on your credit report this forum has alot of good info. You just have to read the previous pages. There are sample letters and contact info throughout the previous post.

My husband back in January found them listed on his report & in turn we have been going back & forth. Do all your correspondence via certified mail and do not talk with them on the phone from what I have read. We did initate the correspondence by sending dispute ltrs to all 3 agencies & a verifcation ltr to LVNV. The credit reports changed to collections aquired from another company. This is from a voluntary repo due to a divorce that is alomst 7 years old & the SOL has expired. The verifcation that we received from LVN just showed the original Company, the $'s they want us to pay (included tones of interest) and the SS#. The original creditor disposed of the car at auction and never sent a differential amount statment.

We had requested copies of items to be sent to us and if they failed to do so in 30 days they would be in agreement that this was not a valid calaim and they must remove their claim. When we did not receive this info we followed up stating the fact & confirmed with them the agreement in our 1st ltr that if they did not provide the documents they were in fact stating the claim was not valid.

We have just received another correspondence from LVNV stating that they are researching the info. If we do not hear back from them the 1st of March we will be sending them a demand ltr to remove this claim immmediately or we fill a claim for fraud.

They showed this account as past due, open with terms of 1 month and no payments. The 3 reporting agencies show disputes now and LVNV has changed the status to closed/collection. The credit score has gone back up a little and the creditors that lowered his credit limits have reinstated the accounts as they were.

But I can say it is not a fast process and you will need to be patient. If this goes to court we want to make sure we allowed all parties the time to respond to our request but not too long that LVNV sets it aside thinking we will forget about it. Then when we are not looking they pull this same stunt again.

Good luck and read from page one. It's overwhelming & alot to take in but great info from those who have been there.

Okay i am new to the game and my fiancee had the a/c with sears and he missed a few payments and then lvnv bought the a/c. Should we be asking for a debt verification still? Also i have heard people in the past saying not to contact them is this wise?

Yes LVNV does buy out Sears accounts. We are being bothered by them. They will eventually file suit using Mann Bracken, LLC to file. We paid them off, supposedly just before it was to go to court. We still had judgement against us, and are trying to see that it is removed from our credit report. Any thoughts?

To Marsha: Send a debt validation letter, do not ask for verification over the phone. Send a separate letter stating any and all further communications are only to be conducted through the mail.

To Steve: Contact the appriopriate court clerk. Verify that there is in fact a recorded judgement. Seems to me there could be at least 1 violation each, fdcpa and FCRA.

LL809, I am not sure you will have a legal leg to stand. According the the fdcpa guidelines, the conusmer has 30 days from initial contact to request debt verification. However, there is no 30 day timeline foe the CA to provide such information. The rules say that all collection must stop until they provide that info. If it were as simple as what you are stating, we all would do it. Am I misunderstanding your post?

LVNV funding is a debt purchaser. they buy charged of debts and yes its legal. Most of the debts are Sears, Providian Bank and other various creditors. If you see LVNV Funding on your credit report it should show what debt they are attempting to collect on. If not call them they have a website with their contact information.

LVNV purchased a "charge off" account of mine from an old BP gas card worth 300.00 But LVFN is demanding 800.00 for that same account and won't budge on the amount. The gas card company won't verify the true amount being that it was charged off. Any suggestions?

Damon, sent a letter to LVNV telling them that you want validation of the debt. Tell them that you want documentation showing that the debt exists, what the amount is, and so on. They are not permitted to take any further collection activity unless and until they provide you with verification of the debt.
