LVNV Funding purchases consumer debt such as credit card or retail debt, e.g. Sears & Roebuck. LVNV Funding is commonly known to use intimidating debt collection techniques like repetitive phone calls, collection (or dunning) letters, and reporting derogatory credit information on your credit report.

Guest-here is a link for the SOL period,state by state at http://www.fair-debt-collection.com/SOL-by-State.html#T .To the other poster- I'm not sure what the least amount the collector will settle for-it varys. Some will do 60%,others less. They usually will offer a settlement offer, or you can go to sample letters here, and there are examples of letters you can send..KAren

As far as I am concerned, this company is unethical and they lie about everything. They have resorted to contaction family members in far away states under the guise of wanting to just talk with me. The harrass these people and when I talked to them, they agreed to let me pay $50.00 towards a debt settlement that is $1200.00. They said that on todays date 5/8/07 that that would be fine and when today came they totally denied the offer and said that they wanted their money in total within 48 hours. I don't have the $1200.00 and will not have it in 48 hrs. so what can I do? I have been unemployed for the last year and do not have access to funds in the amount of $1200.00, what can a person do, I was willing to live up to their original offer but how do you deal with dishonest people like this. I want to pay the debt off however don't harrass me in the process.

Gary please read the top two links in my signature and use the letter in the third link to mail to them.This letter will instruct them to validate the debt and preserve your rights under federal law. Please send it certified return receipt so you have legal proof that they received it.

LVNV can try to collect a debt past the SOL, but cannot take legal action. If they do, be sure and put in your answer to the courst that this is out of the SOL. LVNV, also, is known not to validate debts. I have been dealing with them for over a year, and their many agencies, and have yet to receive a full debt validation, just a computer generated paper they put out with one payment in 2004 and one in 2006. Be prepared for them to just pass their debt to another of their agencies, and start the debt validation process all over.Good Luck!!..KAren

When LVNV purchases an old debt from Providian, does Providian give them all the account information including the signed written agreement card, and the details of all the accounting on the credit card?

I just received a letter from the debt free association stating that I have a lawsuit from LVNV FUNDING (ASGNE OF SHERMAN) but I have never received anything from this company about any debt owed and not to the extent of $3,630.00. What should I do?

A collection agency (CA1) bought my account from another agency (CA2). I had about $470 left to pay CA2, but they said they closed my file and told me to call CA1. So I did and ignorantly set up automated payments to be taken out my bank account. Well the first payment of $55 + $5 convienence fee was taken out a couple days ago. After reading all these forums, I decided to place a "stop check payment" on the upcoming ones for June and July. Was that the right move? Now I'm deciding to send them a letter of debt validation. Would that be a good thing to do considering I already made a payment to them?

Katrina, verify the case in the local county where the case is filed. You will come to know if this is for a real debt and there is actually a legal case against you. If this is true, put a settlement offer to LVNV and make them withdraw the case from the court. Get the PIF letter after the debt is paid.

As I have stated, I have been dealing with LVNV for over a year, and don't believe what they tell you! If I were going to settle a debt with them, assuming it's valid, I would ask for a paid settled letter BEFORE I made that settlement. I did not do this with another company, and they never sent me a letter. The problem is, if there is nothing in writing, they can "bundle" the remainder of your debt, and sell it again,then you are back where you started. To the other poster, I am not sure, but since you have made payments to them, they are assuming you have owened up to the debt. Law student can better answer this for certain. I just saw this on my credit report and when I called this company - I found out it was for an account I settle one year ago.

This is misleading reporting and fraud

I just learned LVNV has also put a collection on my report. I am trying to get a mortgage and it lowered by score by 83 points. It's for a MCI account that I never had. I never used MCI. There's also an address that appeared on the report that I never lived in. Any suggestions on how to get rid of this?
