Sure Gregg, send them the letter in my signature at the bottom of my post certified return receipt mail to validate the alleged debt. Once they receive it send a written dispute to the credit bureaus stating that you have no recollection of ever having an account with Lvnv.

Okay, maybe this is a stupid question....But is LVNV and ASG the same company? And who is Resurgent Capital Services? The first, and only, letter that I got, states that LVNV Funding had bought account from Resurgent Capital Services, but to send full payment to ASG. Can someone explain?

LVNV operates under many "umbrella companies", Resurgent being one of the. They pass it around to all of their agencies, hoping to scare or threaten you into paying something that isn't yours. You can send them a debt validation letter, they won't respond, or respond in full. If it is on your credit report, dispute that and they will see if the debt is valid or not. I have sent DV letters for a year and a half to them, no complete validation, just pass it around, alot of threats, etc. Keep copeis of all correspondence with them as well as any contact info you have. I would suggest not talking with them on the phione, they get pretty nasty-record if you do, and it is legal in your state..Good Luck..KAren

lvnv funding is not your original creditor. They purchased your debt from one of the companies that you owed money to. I have them on my credit report and the original creditor was MCI.

They like to keep things on your credit report even though it's already paid off. I paid my MCI through a different collection agency and settled it. I paid it in Dec 06' and it's now 6/07 and it still shows that I have a balance.

I recently contacted them, and they will inform me if they will remove it from my credit report in the next couple of days. I will wait & see.

So, what you need to do is, contact LVNV & find out who they purchased your debt from.

I have an old debt that was purchased by LVNV several years ago. It is only $900 and I want to pay it off. However, I am afraid that if I pay it, it will keep the reporting window open and I will have it on my credit for 7 more years from the date I pay it. Is this true? Thanks for the advice.

I know that the SOL for most debts is usually 7 years, but doublecheck with your state's laws. Once you make a payment on the debt, the clock does start from ground zero again and collection activity can resume.

Horrordays, the statute of limitations has probably already run on that alleged debt (depending on your state). This has nothing to do with the length of time it is on your report. LVNV is the leader among junk debt buyers who try to shake down consumers. Have you received any letters about this from LVNV, or any of their many companies?

Re: Acct # XXXX-XXXX-XXXX-XXXX

To Whom It May Concern:

I have received your letter where you claim that I owe a debt to you and/or your company. This letter is being sent to you in response to your attached collection letter. This is not a refusal to pay, but a notice that your claim is being disputed by me. I do not recognize your company and I do not believe I owe you or your company this debt.

Under the Fair Debt Collections Practices Act (fdcpa), which I assume you are aware of, I have the right to request validation of the debt you say I owe you. I am requesting proof that I am indeed the party you are asking to pay this debt, and there is some contractual obligation which is binding on me to pay this debt. Below are a few questions to answer which may help you to resolve these mistakes.

In addition to the questionnaire below, please attach copies of:

? Agreement with any of your clients that grants you the authority to collect on this alleged debt

? Agreement that bears the signature of the alleged debtor wherein he agreed to pay the creditor.

? Any insurance claims been made by any creditor regarding this account

? Any judgments been obtained by any creditor regarding this account

Best regards,

RE: Account # 1234567890

Dear Sir or Madam:

As per Federal Law (The Fair Debt Collections Practices Act, Section 805) I formally request that you CEASE and DESIST ALL your efforts to collect on the above referenced account and debt.

You are hereby instructed to cease collection efforts immediately in any way, shape or form, this includes phone calls, letters, faxes, third party contacts, internet, calling my place of employment, contacting my friends, neighbors or family members.

If you fail to follow my Federal rights as per the FDCPA I will make sure that you face legal sanctions under applicable Federal and State law.

Do NOT call me, write me, contact my relatives, friends or work place in any way after you receive this letter because that will mean you are violating FDCPA and I will not hesitate to sue you for Federal Law violations which allow me to sue you for $1000 per violation as I'm sure you're already aware.

I will not hesitate to file complaints with the Federal Trade Commission, my and your Attorney General's Office and seek legal action personally if you ignore this letter!

GIVE THIS LETTER THE IMMEDIATE ATTENTION IT DESERVES.

Check out budhibbs (I cant post the link in here, but you can add the three w's and the dot com at the end OR just Google it

Don't pay a thin dime OR penny until you have talked to Bud. You may not have to pay this debt if the Statute of Limitations, commonly called SOL, has run out. If the SOL has run out then the debt collector is SOL. (shite out of luck)

I have tried to contact lvnv several times, several other companies handle their accounts. I paid them off with a settlement in 2003, they have no record of it. No one knows anything about contacting them directly. When I have gotten a # directly to them it rings off the hook, no answer. However, conveniently, these people dont lose count of how much you owe with interest.
