Now im being told since my info was last reported in 02/02 it will have 7 years to be removed. I had the idea that the SOL was only 5 in Florida. What to do next. Wait till March of 08? I inquired to Budhibbs.com and got that answer.

I need to send a certified letter to this company, but all I see is a PO Box. Can anyone provide a street address?

we were sevrved with a summons from LVNV funding, for a car loan we had with wells fargo. They have it listed on here, that we owe them the money. If we have not signed a loan with them do we? Also we have NO money for an attorney, how do I fight this as I feel that the statue of limitations may have ran out. This is for 10,355 for a voluntary repo, after a job loss.

I had defaulted on a credit card in 1999, LVNV is a collection agency who acquired the account. They had the gall to sue me in court through a local attorney in NJ, and won...

LVNV funding - Resurgent Capital - Sherman and other affiliated collection outfits were set up to work the junk debt market proficiently. The owners of LVNV funding, a clever name for Las Vegas, Nv funding, another clever play on words, bid on, for example, old charged-off debt, the winning bidder usually paying maybe 3 cents on the dollar for tens of thousands of these old, sometimes old old debts. The entity LVNV then conveiently hands the bundle of accounts to, lets say affiliate yet separate entity Resurgent, located in South Carolina. Resurgent's auto-dialer then begins a long campaign of dialing each of those charged-off accounts "debtors" phone numbers. Once they get a "live one", they might call many times over a few weeks, sometimes 4 or 5 times a day, a hundred times overall. They will use dunning scripts and depending on what you say, will probably give you a canned answer. Their ultimate daily goal, persuade you to give them your money, quickly. Don't be fooled or pressured by their strategies. These outfits try and make money from the misfortune of others. It may be best not to reward them for their behavior. They may operate just this side of what's legal and sometimes otherwise. Fortify yourselves, learn all you can about your legal options. Have fun empowering and legally protecting yourselves. Learn all you can and do whats ultimately best for yourself and families. The above outfits make commissions on every dollar people donate to them. They deserve none of your scarce money. You're far more important than anyone's desire to make a large commission.

We had an outstanding balance with MCI in 2003 or so. They charged us wrongly. The amount was $248.xx. We finally wrote them a letter and explained the situation to them. MCI didn't work with us, but they sent our debt to a collection agency. We agreed to pay half of the amount charged, which was $124.xx, and the collection agency offerend to settle the matter. However, the collection agency sold the remaining amount of $124.xx to LVNV Funding. I was told that I can settle the issue by writing a letter to them, informing them that the debt has been disbuted, and I should send copies of my correspondes to them.

After all these years, I do not have the files on hand. The only thing I have is a copy of the letter I sent to MCI in August 2004. How effect will it have for me to even write a letter to LVNV to get my CS back up, if I don't have any proof????

I have a debt that this company purchased. I've tried to settle and have an old settlement agreement that was not honored, I was bounced back and forth and now I cannot get anyone to work with me. Niagara Credit Services represents LVNV and they want 30% down a monthly payment and then after a year will consider a settlement. Any suggestions how I can get this settled for less than 60%?

Any suggestions how I can resolve this debt? Original settlement arrangements were in writing last Dec, and I got bounced around so no where to make payments. Now Niagara wants 30% down, monthly payments, charge interest and then maybe a settlement in 10 months...in other words they want money and no settlement....any suggestions? Should I contact LVNV instead of Niagara, which by the way does not see any of this the way I do....I just want to clear this up and cannot pay the full $7000.

Niagra is a new one for me-dealing with LVNV. I am aware of many, many other names that deal with them, but not Niagra. Whoever you ar dealing with, LVNV will go back on their word, won't fully validate, and won't work with you. What I did was, I sent a letter with a money order for what type of down payment I could afford, and said this is the down payment. I also stated I would make xx dollar payments until the 70% was settled, as they had previosly offered- by that time, it had dropped to 50%. They were not happy, but I sent it any way. The way I figure it is, I am trying to make payments, settle this and move on. If they decide to take me to court, I have documents showing all my correspondence and phone conversations with them, and they wouldn't work with me.Try not to talk to them on the phone any more than you have to- you won't get anywhere with them, and they will make you miserable. Hang in there, and keep us posted..

We keep getting a collections notice from this company. We called them and it is for an account that we never had. And it is not on any three of our credit reports. They were not friendly with us at all and would not even discuss the account. They just told us that we need to pay the debt in full. We have written letters to dispute the debt, but never hear back from them. Any insights?

If this is not your account, I would send them a Debt Validation letter, where they have to prove it is your debt, and a cease and desist letter. Tell them in the C&D letter that they are not to contact you, except by mail, that this is not your debt, etc. Make copies of everything, and send all correspondence certified, return receipt, or some means that they have to sign, and you have proof they got the letter. Do no try to talk to them on the phone- you will get no where. Don't be suprised if you do not get validaton, or get a computer generated paper full of nonsense. If they contact you after you send the cease and desist letter, keep notes or recordings of it, this is against the law. Feel free to ask questons!!..KAren
