DOL: date of last activity is the date when you made the last payment for this account SOL clock starts from this date. Every state has its specific statutes of limitation. So you have to check when the account will be declared uncollectible legally. You can check this thread also-

To Whom it May Concern,

My credit rating was negatively affected by your entry to the 3 National Credit Bureaus. My dispute with you is that I didn't have a account with Sears in 2003. This is false information reported on my account. The account ifformation that I recieved is:
Date opened - 06/2003
Account # - xxxxxxxxx
Type - Installment
Credit Limit - $2,584
This has to be someone else's account, because I haven't dealt with Sears in over 15 years. Please check this out and remove it from my credit reports. You can contact me at:

John, you have to send this letter to the credit bureaus through certified mail with return receipt requested. Otherwise it won't work. Hope you understand.

Also do not disclose your personal information in any open forum; any one can use it fraudulently. Thanks Mike for helping John protect his privacy.

Hello! I just received a settlement offer from LVNV funding LLC and the addresses you listed does not even come close to what they have for me...I have FMS INC PO Box 707600 Tulsa, OK 74170-7600.. And i really don't know where the debt is coming from..And also is there an email for them cause I am in the military and stationed in IRAQ..

Thanks for updating the address. You can search for them with BBB website to get a correct email address.

However, as you have their address, send them letters too because snail mails are good for evidence.

The number to reach LVNV Funding is 888-665-0374. Ask them about the account for which they have hit your file. The company should give you the details of the debt in writing. If they do not respond to your request, highlight the item and dispute with the bureau. They will investigate the matter with the CA and if your dispute is correct, the item will be removed from your file. Don't let LVNV Funding hurt your file for wrong reasons.

This company showed up on my credit report also. I tried calling the number they provided and it turned out to be someone home phone. I was contacting them to set up a re-payment arrangement but can't get through to them. The phone number that they have listed is 866-464-1183, tha address is PO Box 10497

I assume you have this company reporting in your credit file. Call them and inquire about the account. If the company fails verification, dispute with the bureaus and get the item removed from your file. Inaccurate collections hurt your credit file severely and lower down the scores. Ensure that your credit is being reported with accurate information.

Can some one tell me if you have seen this on your CR, My credit is with Providian and they charged it off it is also 7yrs old, and sold it to LVNV, But on my credit report LVNV showes in as a new charge with an open date of 3/2004. I have never seen any other colletion co. report a collection account in this manner. But because LVNV is doing this my credit score is lower. I called them to try to settle it. they said I had to give them a post dated check over the phone so that the settlement they were offering would be valid, When I told I would not give them a check because I did not have the money in the bank they didn't care they just wanted the check. When I refused to do it that way and asked for an offer letter first, he said the offer of off and I had to pay the full amount and he got rude, and hung up on me.
So how do I prove that is charge is over 7yr and get them to take it off the CR.

Request in writing CMRRR for a validation of the debt, also contact the CRA's and inform them that you are disputing the debt. The date would be of the last activity on the account, not the beginning of the date of delinquincy.

Mel, dispute this account with the CRA reporting it. The account should appear in your file for seven years starting from the date of first delinquency. If the account is past this period, LVNV cannot re-enter it in your file. Under the FCRA laws, it is violation of the consumer protection act (Section 605) if a company or a credit bureau tries to reage the accounts and keep negative information for longer period. You can actually repair your credit by suing them up to $1000 for each violation.

Default LAWSUIT FILED BY LVNV

Lvnv has filed a lawsuit against my mother. She has no idea what company transferred information to lvnv. This is a woman that has always paid her bills and paid them on time. She is 82 years of age and lives on social security. What can she do?
