What state do you live in? When was the last time you paid Sears?

SOL in NC is 3 years. Has it been 3 years since your last payment to anyone on this account? When was the Date of First Default and is this still reported on your credit reports?

Your last payment was more than 3 years ago or it's on your crdit reports? It really sounds like this is out of statute but without all the facts I can't say for certain. Can you provide a timeline?

In order to take it off your credit report, you have to file a dispute to the credit reporting agencies and state that it is not your debt.
If it *is* your debt, then it will be on the credit report for 7 years.

Inquire with your HR Dept at work as to how the garnishment is taking place (ask for a copy of the court order) and then call the court and file a Motion to Dismiss due to improper venue (you have to prove that they filed with court case without your knowledge because you were served the summons in an improper manner - i.e. you never got it).

i have a charged off acct from your company. it was turned over to sessoms and rogers p.a in durham n.c. my question is that this group has sent me a letter stating under the new review i have to increase my payments to you from 50 to 100. they said this was due to financial situation. i have without them consulting me have lost my wages by half. i cannot afford what they are asking me to do,but since you took a civil summons against me what then? i can still afford the 50.00 per month not 100. due to the fact my wages have decreased i cannot afford 100. i guess they talked to you guys and sent me the letter.
respectfully yours,
brandon barragan
