An LLC has sued us via chase bank. Two dates are on the summons. No where is there a court date NOR is there a date marked when we received. The same sommons arrived in the mail without a return address. There is a sworn affidavit of sale to this LLC. They have my name and my daughters address and niether of us know anything about this account.

what should we do?

Call your local county civil court and verify the court date and ask them what you need to do.

Don't forget to also ask how to file a Motion for Discovery.

@ annoyed & confused: There won't be a court date on the summons and complaint. Depending on where you live, you have a limited time to file an answer, which you must do. If you cannot afford a lawyer, go down to the courthouse in person, and ask the clerk for a pro se answer form. It's free. fill it out. You will then be mailed a court date.

@maurice: check his credit report and see if it's on there, and call the attorney and ask him what the debt is about. Sounds like your son had a judgment entered against him by default, so he might want to go down to his local courthouse and file your district's equivalent of an order to show cause to vacate a default judgment.

i would check with your court clerk on that.LVNV is an ultimate bottomfeeder.chances are they went ahead with the suit.did you get the arrangement in writing?if not then they most likely agreed to the arrangement so you don't show up to court.check with your court clerk to be sure.
