check with your court clerk to make sure this is legit.if a suit was filed they will have it on record.if not get a DV letter out.send it certified mail return receipt.if it is legit answer with your court clerk nobody else.lvnv is a bottomfeeding bad collector.never trust them at all.

I was sent a process letter in the mail from the county sheriff dept from lvnv funding llc but dont have a clue what its for , but i searched it through the sheriff dept. and it shows the attorneys where its coming from should i call and see who they are representing ? help me out here.

You need to check your local court house to see what was filed. It could be a scam but it's a start. If a lawsuit was filed you may need an attorney to fight this as it gets complicated. Failure to answer a summons in the time limit, usually 20 days, can result in a default judgment.

Who is the law firm suing? You can try calling, stay calm and firm. Only ask who the original creditor is, assignee and who they are suing for. Once you get that, say thank you and hang up, no further conversation. Do not admit to the debt over the phone either.

I too am being sued in court by 2 different law firms one in my state Mass and one from newyork .one say that i owe citi and my credit report shows them paid off and closed/not charged off 3 accts 6/2003 9/2002 11/2001. And it looks like the one ther bringing me to court they put looks like a false acct # on my report in 5/2005. It is still open and says high bal 3000 and owe 6000. I keep going to court saying i don't owe them and they keep dragging ther feet. It was suppose to go to trial but they asked for another pretrial date because i told him the lawyer that i have proof with my credit report. he asked me to fax it to his office. (i think not) So instead of them sending me a letter for the proof they send me one to call them to make arrangements to pay . i cant beleive them. i know they have no proof because they seem to keep strecthing it. i have sent them a letter today for validatino before we go to court again. I feel like sueing them for errenous marks on my credit report and time and aggravation they are putting me thru when it's all over. I did not send them the proof because i hope they loose in court if not for the sol. And for putting a loan on my credit even though my creid report says it will be removed on 2/2010 .And for the sear one if i remember i don't know how much i owed them but it's not on any of my credit reports sent them a letter to validate info. Some feed back would be appreiciated

david, i cannot believe you have advised her to contact these people without strongly also advising her to check the sol on the acct first, among other things!

generally you do not contact any debt collector , ESPECIALLY LVNV, without checking more into the background of the so called debt, first. they do alot of illegal and questionable things.

as you can see, they do not operate with your well being in mind and probably not legally, i.e.-letter of offer for payments, then when you contacted them they pull that offer right off the table!

these kind of debt collectors (DCs) are bottom feeders and just buy old debts/debts from other bottom feeders and it goes on and on. and it is legal for them to do that. not legal alot of times how they try to collect these debts. and there are many many of these collectors, collection agencies, debt collectors, etc. it's a giant business in the U.S.
what state are you in kchristie?

dates are very important in a matter such as this. if they filed the info with the credit bureau after the SOL date (Statute Of Limitations for your state) had passed you might be able to dispute it with the credit bureau, send a certain kind of letter, etc.
hopefully someone with more experience than I, on this site , will come along soon. but research this site....use the search box at top of each page, this site is great and has a wealth of info, examples of letters to send, etc.

If (and only if) they get a judgement against you, they can garnish your wages or levy your bank account. If your tax return happens to be in said account at the time (direct deposit), then, yes, they can grab it.

LVNV can not offset your tax refund directly through the IRS. Only the IRS can do that, and they'll only do it in cases where you owe a government obligation. Back taxes, past-due child support, defaulted student loan, things like that.

There are some things you can do to make certain your refund stays yours. Getting a paper check is the most obvious. Any Wal-Mart will cash a tax refund check for about $3. Or you can do a direct deposit into an account controlled by a trusted friend or relative. Or into your own account, then withdraw the funds immediately. I checked my credit report and saw that L.v.n.v. funding in Greenvill S.C. appears on my credit report since 2007 and only one payment was delayed leading to collections.Since then every payment have been made on time,( it's funny) I've never heard of such company and this is the first time it appears on my credit. Well I have something for L.V.N.V Funding. See I'm a law enforcement officer and have requested a full investigation with the FBI fraud div.out of South Carolina.' Oh yeah did mention' I will be bucking a flight Monday to visit management in LVNV Funding to see what proof they have on me. This is a shut case it should not take me more than five minutes to complete. I'll keep all informed.
