I'm glad there is an agency reporting to the credit agencies about issues i may have already paid off! i am also grateful for all the wonderful phone numbers they provide!! i am glad their phones dont even ring when you call them!! Is this for real!!! get a clue if you are going to be ruining people's credit or reporting bogus info, at least get a real phone system so the people trying to get ahead in life can continue to do so without this little operation hampering those efforts to get a real contact to Verbally dispute them. Not wait weeks on end with snail mail!!

I filed bankruptcy on March, 2009, the account was with Bank of America. They still have a judgement at the court house against me.

I have LVNV funding on my credit report too but the original company is also on my report for the same debt. Is it legal for companies to double the information on your credit report to make it look worse than it is? It also has different removal dates which I think it should be the earliest one. Is there more information you have on this situation?

I have a negative listing from LVNV and i tried to make contact letting them know i was recording the phone call. They refused to talk to me as long as i was recording the phone call. I am about to fac them a letter requesting settlement of the account. They kept referring me to CMS when i asked them for a settlement and CMS said they have not had that account in their office since jan 09. if LVNV does not accept the settlement offer, what can i do to remove this from my credit file?

Hi Vincent,
Did you check if the negative listing by LVNV is legitimate? Did you check if they really have the right to collect the debt from you and report it to the credit bureaus? Before you make a settlement offer to them, send them a debt validation letter. If they cannot validate the debt, they have no right to either collect it from you or report it to the credit bureaus. You can then send a request letter to the bureaus along with the required evidence, asking them to remove the negative item from your credit report.

Hi meremanda,

When you send a debt validation letter to the collection agency through certified mail with return receipt requested, they are required to send you proof to validate the debt. If they cannot validate the debt and is non-responsive to your validation letter, you can send the credit bureaus the signed green card and the copy of the validation letter as evidence that you did dispute the debt with the collection agency. The signed green card will prove that the collection agency did receive the validation letter on a particular date. As per the Fair Credit Reporting Act the collection agency is not supposed to report the account on the credit report if they cannot provide you any proof to validate it.

Do not pay these BOTTOM FEEDERS a dime. They bought your debt for pennies from the original debtor and try to collect the entire amount they claim you owe. Send them a letter of Validation of the debt with your original signature. Chances are (90%) they have nothing to prove the debt. If they file a law suit against you to try and collect, (it won't be from them, but one of their Lawyer partners in your area) who will try to scare you into settling or making payments. DON'T talk with them but send them a letter to Validate the debt. They can't either. When it does go to court, SHOW UP and when their lawyer calls you, you ask again for Validation of the debt. They were hoping you wouldn't show up so they could win under default. Thats how they make so much money becuas they can now take your default and take it to settlement court and place a lein on your paycheck and your checking account. If you show up they will either have to show Validation of the debt with LVNV not the original creditor like citifinancial that shows your signature. By all means, don't give them a dime or give them any checking account or credit card or debit card information. They will steal you blind. If the case gets dismissed make sure you get it dismissed with prejudice so they can't refile down the road. Know your legal rights. Once the original debtor wrote off your debt, that's it. It may follow you for 7 years. But you don't have to pay LVNV a dime because they bought your debt for pennies.

If you were served and did not answer, you waived your defenses. HOWEVER....if they filed after the statute of limitations, you could have a claim for misrepresenting the nature of your debt. If your claims against them are not past the sol, it is worth a shot to go after LVNV Funding for deceptive action in the lawsuit against you.
